Juni 2012   Gesuch um Abänderung einer Baubewilligung im Nachvollzugs-  verfahren; Wiederherstellung des rechtmässigen Zustandes   - Wird in einer Verfügung zur Wiederherstellung des rechtmässigen Zustandes nicht   der klassische Bauabschlag (mithin der Rückbau), sondern die Rückversetzung einer   umstrittenen Dachlukarne angeordnet, so kann der Bauherr dazu verpflichtet werden,   detaillierte Ausführungspläne zu hinterlegen. Dasselbe gilt in Bezug auf Terrainauf-  schüttungen, welche die Gemeinde in ihrer Verfügung zur Wiederherstellung des   rechtmässigen Zustandes vorschreibt.   - In Anwendung des Störerprinzips ist der Bauherr als Verhaltensstörer zu quali-  fizieren, da er den polizeiwidrigen Zustand (eine formell und materiell rechtswidrige   Baute wegen Missachtung der Baubewilligung) geschaffen hat. Die Stockwerk-  eigentümer, welche die umstrittenen Wohnungen zwischenzeitlich erworben haben,   gelten als Zustandsstörer, da sie über die Sache, welche den ordnungswidrigen   Zustand bewirkt, die rechtliche und tatsächliche Gewalt haben.   - Die Gemeinde hat an den Bauherrn eine Vollstreckungsverfügung und an die Stock-  werkeigentümer eine Duldungsverfügung zu adressieren.
