47 The IfD survey « Unverpackter [...]-Riegel » contains a number of
deficiencies, especially with regard to the core question on
distinctiveness (G2) and diverges from the methodology endorsed
and accepted in Switzerland by the IPI in several aspects. However,
from an empirical legal research point of view, these deficiencies do
not appear to be so serious that the survey would not be of any
value for the design of the coloured « [...]» bar, thus the survey
could serve as a rough estimate for the degree of distinctiveness.
