(2) The colour of the depiction : Furthermore, the depiction used in the
current survey on the « [...]» shape was black and white (in order to
comply with the trademark registration). The image used in the IfD
survey, by contrast, was coloured brown which might have visually
evoked more « concrete memories » regarding the real [...] chocolate
bar than a black and white image (cf. my expert statement on the IfD
survey, para. 11).
