She has been unable to achieve any relief\nfrom these aversive experiences. She is also distressed by\nthe disfigurement and deformity of her face and ears,\nalong with the resulting facial asymmetry. She cannot look\nat herself without becoming distressed and each time she\nis forced to re experience the nightmare of how her face\nhas been transformed. The restricted range of motion has\ndisruptive effects on activities such as driving, which is an\nenormous handicap, living in the USA where she is forced\nto live since she cannot function independently. As a\nresult of the above, she has developed a severe\ndepressive disorder, which has further disrupted her life,\nand together with her pain and physical dysfunction has\nproven to be an insurmountable impediment to work and\nsocializing. Her condition has extended over several years\nand is solely caused by the effects of the cosmetic facial\nsurgery.\n(…)\nIn spite of the lack of benefits from treatment, she has\ncontinued to avail herself of treatment in the hope of\nfinding relief. She has made every effort to improve her\nconditions and there is no foundation to any implication\nthat she has failed to avail herself of treatment or that\nthere exist treatments that would have remedied her\ncondition and enabled her to return to work. Her\nemotional and physical reactions are profound and\nincapacitating and this incapacitation is ongoing. She has\nbeen unable to resume work solely as a result of her\nemotional and physical condition arising from the surgical\noutcome. As to causation, her conditions are the sole\nresult of the cosmetic facial surgery. There is no basis for\nany other causal factors and Ms. X.________ does not\ndisplay any features of Malingering, which is always a\nconsideration in a forensic setting. I did not find this to be\na factor for Ms. X.________, who has cooperated with\ntreatment and continues to seek remedies for her\nconditions. Her conditions are the direct result of the\ncosmetic facial surgery, which she would not have\n-6-\n\nundergone had she been apprised of the likely outcome by\nDr. S.________ and no other considerations are felt to\napply.\nI believe she is a candidate for ongoing treatment from\nboth a psychological and psychotropic standpoint.\"\nPreuve : pièce 90 (pages 9 et 10).\"\n\n3. Durant l'instruction, plusieurs expertises ont été réalisées tant\npour déterminer si l'intimé avait commis une faute lors des opérations de\n1990 et 1991 que pour évaluer les conséquences de ces opérations sur\nl'état psychique de la requérante. Le Dr L.________, psychiatre, a ainsi\ndéposé un premier rapport d'expertise le 26 janvier 1998 dans lequel il\nconcluait que la requérante souffrait d'une décompensation anxiodépressive grave d'une structure de personnalité névrotique de type\nhystéro-phobique, aux traits narcissiques, associé à un repli social\nimportant, secondaire à des séquelles de chirurgie plastique [cicatrices].\nL'expert exposait notamment ce qui suit :\n\n\"[…]\n2) Histoire personnelle, antécédents médicaux\n[…]\nElle [réd. la requérante] n'a pas d'antécédent médical, chirurgical ou\npsychologique particulier en dehors de la leichmaniose déjà citée,\nrien notamment qui puisse suggérer un trouble psychologique\ngrave; le deuil de sa mère semble s'être bien fait.\n\n"}
