      "Text": "Nachsteuer, geldwerte Leistungen, Art. 151 Abs. 1 DBG, Art. 20 Abs. 1 lit. c DBG (SR 642.11). Bei der Veranlagung einer AG wurde die Leistung von Honoraren als geldwerte Leistung rechtskräftig als Gewinn aufgerechnet. Empfänger der Honorare war der Vater des Verwaltungsratspräsidenten und –delegierten sowie Minderheitsaktionärs der AG. Der Vater hatte der AG ein Darlehen gewährt und in der Folge auf Zinsen sowie auf die Darlehensforderung verzichtet. Gegen den Verwaltungsratspräsidenten wurde zu Recht ein Nachsteuerverfahren eingeleitet und dabei die geldwerte Leistung bei ihm als steuerbares Einkommen erfasst. Die Aufrechnung als geldwerte Leistung bei der AG präjudiziert als solche beim Empfänger den Einkommenszufluss nicht; dieser ist im Veranlagungs- oder Nachsteuerverfahren festzustellen (Verwaltungsrekurskommission, Abteilung I/1, 19. Januar 2012, I/1-2011/16)."
