      "Text": "Baurecht. Streitig war, ob die Vorinstanz im angefochtenen Rekursentscheid zu Recht die Beschlüsse der Gemeinde vom 9. Mai 2023 (Einspracheentscheid und Baubewilligung MFH sowie Verfügung einer Sichtzone für die Tiefgaragenrampe) mit der Begründung aufhob, das geplante MFH verletze den – gegen die Hauptwohnseite einzuhalten-den - grossen Grenzabstand. Das Verwaltungsgericht hielt unter anderem zu dem im angefochtenen Entscheid angeführten Umstand, wonach die Längsseiten (Nord und Süd) der geplanten Baute grössere Fensterlängen und -flächen aufweisen würden als die Schmalseiten, fest, dass sich hieraus kein Argument für die Nordseite als Hauptwohnseite ergebe, zumal sich die Festlegung der Hauptwohnseite an der Nutzung orientiere und von daher auch eine der Kurzseiten als solche in Betracht falle. Zum Kriterium der durch die Fassadenfenster belichteten Raumfläche hielt es fest, dass aufgrund der Nutzungsorientiertheit der Hauptwohnseitenfestlegung die natürliche Belichtung von Aufenthaltsräumen kein ausschlaggebendes Kriterium für die Festlegung der Hauptwohnseite darstelle, zumal vorliegend die zureichende natürliche Belichtung sämtlicher Aufenthaltsräume von keiner Seite in Frage gestellt werde. \r\nBei den Aufenthaltsräumen mit besonderer Bedeutung für die Wohnnutzung solle die Besonnung durch den grossen Grenzabstand verbessert werden. Ein grosser Grenzabstand vor der Nordfassade könne im Vergleich zum kleinen Grenzabstand weder die (konkret im Herbst, Winter und Frühling fehlende) Besonnung noch die Belichtung und die Aussicht der hinter der Nordfassade gelegenen Räume verbessern. Sodann wirke einerseits die an der Nordfassade verlaufende offene Tiefgaragenrampe für diese Grundstückseite eher attraktivitätsmindernd; anderseits sei mit festzuhalten, dass die an die Westseite angrenzenden Wohnbauten mit Tiefgaragenzugang gewisse Lärmimmissionen mit sich bringen dürften. Für die Westfassade als Hauptwohnseite spreche indes zum einen die hinter dieser Fassade vorgesehene Nutzung Essen/Kochen/Wohnen und die ganzjährige Besonnung des westlichen Bereichs am Nachmittag/Abend sowie zum anderen die – wenn auch nur bescheidene – Seesicht (gegen Nordwest) und der Aussenbereich/Grünbereich mit davorliegendem Gewässerraum; letzterer schütze den Aussenbereich aufgrund seiner gewässerschutzbedingten Unverbaubarkeit. Unter diesen Umständen habe das geplante MFH gegen Westen den grossen Grenzabstand, gegen Süden und Norden den kleinen Grenzabstand und gegen Osten den Strassenabstand einzuhalten. Der angefochtene Entscheid, mit welchem die Nordseite als Hauptwohnseite bestätigt worden sei, lasse sich nicht aufrechterhalten. (Verwaltungsgericht, B 2024/31)"
