      "Text": "Art. 426 Abs. 2 StPO (SR 312.0) Auferlegung von Verfahrenskosten an den Beschuldigten. Der Beschuldigte wurde von der Polizei anlässlich einer Verkehrskontrolle als fahrunfähig erachtet, weil er nach Alkohol roch und sich auffällig verhielt. Die anschliessende Auswertung der Blut- und Urinprobe ergab hingegen keine Hinweise auf Betäubungsmittel und nur eine Blutalkoholkonzentration im zulässigen Rahmen. Das Verfahren wurde deshalb eingestellt, dem Beschwerdeführer aber die Kosten auferlegt. Die Anklagekammer hob den Kostenspruch im Beschwerdeverfahren auf, weil gemäss bundesgerichtlicher Rechtsprechung ein erlaubter Alkoholkonsum (anders als bei Drogen) kein zivilrechtlich vorwerfbares Verhalten darstellt, das eine Kostenauflage rechtfertigt (Präsidenten der Anklagekammer, 23. Juni 2017, AK.2017.167)."
