      "Text": "Art. 4 VVG und Art. 6 aVVG (SR 221.229.1) Teilt der Anzeigepflichtige dem Versicherer bei der Antragsdeklaration wahrheitsgemäss mit, dass und bei welcher Versicherung für das gleiche Risiko bereits eine Versicherung besteht, so ist die gleichzeitig unrichtige Angabe einer nicht mehr aktuellen Policennummer nicht als erhebliche Gefahrstatsache im Sinn von Art. 6 aVVG zu qualifizieren, welche die Versicherung zum Rücktritt vom Vertrag berechtigen würde (Handelsgericht St. Gallen, 30. April 2007, HG.2006.72).Das Bundesgericht hat dieses Urteil bestätigt (Urteil 4A_191/2007 neues Fenster vom 22. August 2007)."
