      "Text": "Art. 162 BV (SR 101). Zwischen den Parteien war streitig, ob von den Gesuchstellern beanstandete Äusserungen der Nationalrätin Jasmin Hutter in der Presse und anderen Medien im Zusammenhang mit der von ihr am 4. März 2004 eingereichten Motion Aufschub der Russpartikelfilterpflicht auf Baumaschinen von der absoluten parlamentarischen Immunität umfasst sind oder ob die Nationalrätin für ihre nach Einschätzung der Gesuchssteller lauterkeitsrechtlich relevanten Äusserungen einzustehen habe und ihr die Gesuchssteller vorsorglich verbieten lassen können, die beanstandeten Aussagen in jeder möglichen Art weiter zu verbreiten. Der Handelsgerichtspräsident hat entschieden, dass die Nationalrätin auch absolute Immunität i.S.v. Art. 162 Abs. 1 BV geniesst, insofern sie lediglich den Wortlaut ihrer Motion im Ganzen oder in Bestandteilen in der Presse oder in anderen Medien wiederholt. Auf das Gesuch um Erlass vorsorglicher Massnahmen wurde deshalb nicht eingetreten (Handelsgerichtspräsident, 30. März 2005, HG.2004.78)."
