der Beklagten bereits mit Fax vom 7. Januar 2002, d.h. vor der Reparatur der
Maschinen, das Angebot machte:

"(...) Please note that as per the surveyor’s report the cargo is considered as
constructive total loss. We therefore (...) request you to have a survey of the cargo if
you deem necessary." (kläg. act. 23)
