Our statements made\nconcerning the damages were based on a visual impression we obtained visiting at\nKermanshah customs the damaged machines. Further impressions we got through the\npictures taken on this occasion. If, in spite of our opinion, a refurbishment should be\ndone, it will require that the damaged equipment is sent back to Switzerland whenever\npossible. Otherwise, a specialist for each machine should be sent to Kermanshah to\ninspect them. The real inspection can only take place in a workshop equipped with\nhigh precision measuring devices, levelled assembling platform, long range\nmicrometers, etc. The machines have to be completely dismantled to verify each piece\nand to list what has to be exchanged and afterwards assembled again by a specialised\nengineer. This is very time consuming and the reason why we think that a replacement\nwill be faster and cheaper.\" (bekl. act. 5 vom 5.12.2001)\n\n\"In addition to the Memo of 20th November 2001 (...), the provisional statement\nconcerning the weighing scale has to be precised. The bending suffered in the structure was caused by\nsuch an impact that inner parts of the scale are certainly damaged in a way that a\nrefurbishment is not possible; the scale should be completely replaced.\" (kläg. act. 21\nvom 7.12.2001).\n\n\"(...) To establish the repair costs, we had to consult different sections and re-study\ncarefully the pictures, as besides the visual impression at site, we had to base our\nanalysis for the cost estimation, on these pictures taken at the customs in Kermanshah.\nWe studied each damaged item and considered the operations involved for the\nrefurbishment as there are: internal transport in the factory, dismounting, visual sorting\nout, detail measuring and control of the reusable goods, establishment of the list of the\ndamaged parts, programming of the manufacturing with follow-up of these parts,\n\n© Kanton St.Gallen 2025 Seite 5/51\nPublikationsplattform\nSt.Galler Gerichte\n\nmanufacturing of the damaged parts individually, assembling and repainting of the\nmachine, testing and final control.\n\nThe manufacturing cost of individual parts outside of a serial production is at least 30\n% higher than the manufacturing in serial production, as the programming, setting time\nof the machine is per one part much higher than for a series of the same part.\n\nWith respect to the motors, which are outsourced, we considered the transport to the\nsupplier and similar operations as stated above for the pieces manufactured in our own\nfactory.\n\nEven taking into consideration all these detailed work, Bühler cannot take warranty for\na refurbished machine, as we do for a new one, as it is refurbished.
