      "Text": "Schulrecht (Berufsbildung), Art. 29 Abs. 2 BV. Gemäss Art. 29 Abs. 2 BV haben die Parteien Anspruch auf rechtliches Gehör. Aus dem Grundsatz des rechtlichen Gehörs leitet das Bundesgericht in ständiger Rechtsprechung die Pflicht der Behörden ab, ihre Verfügungen und Entscheide zu begründen. Der Grundsatz des rechtlichen Gehörs als persönlichkeitsbezogenes Mitwirkungsrecht verlangt, dass die Behörde die Vorbringen des vom Entscheid in seiner Rechtsstellung Betroffenen auch tatsächlich hört, sorgfältig und ernsthaft prüft und in der Entscheidfindung berücksichtigt. Daraus folgt die grundsätzliche Pflicht der Behörden, ihren Entscheid zu begründen. Der Betroffene soll wissen, warum die Behörde entgegen seinem Antrag entschieden hat. Die Begründung eines Entscheids soll verhindern, dass sich die Behörde von unsachlichen Motiven leiten lässt, und dem Betroffenen ermöglichen, die Verfügung gegebenenfalls sachgerecht anzufechten. Dies ist nur möglich, wenn sowohl er wie auch die Rechtsmittelinstanz sich über die Tragweite des Entscheids ein Bild machen können. In diesem Sinn müssen wenigstens kurz die Überlegungen genannt werden, von denen sich die Behörde hat leiten lassen und auf welche sich ihr Entscheid stützt. Zusammenfassend ergibt sich, dass sich anhand der Bewertungsunterlagen und der Ausführungen der beiden Prüfungsexpertinnen die Bewertung der mündlichen Prüfung des Qualifikationsbereichs «Berufskenntnisse» nicht nachvollziehen lässt. Damit verletzte die Vorinstanz den Anspruch der Rekurrentin auf rechtliches Gehör und ihr Entscheid mündet in Willkür. Der Rekurs ist – dem Eventualantrag folgend – gutzuheissen. Die Verfügung der Vorinstanz vom 21. Juni 2023 betreffend das Ergebnis des Qualifikationsverfahrens 2023 als Pharma-Assistentin EFZ ist aufzuheben. Die Vorinstanz hat der Rekurrentin ohne Anrechnung des erfolglosen ersten Prüfungsversuchs eine gebührenfreie Wiederholung der mündlichen Prüfung des Qualifikationsbereichs «Berufskenntnisse» zu ermöglichen. Gutheissung des Rekurses im Sinne der Erwägungen."
