      "Text": "Auf Schenkungen unter Lebenden ist das Abkommen zwischen der Schweiz und Deutschland zur Vermeidung der Doppelbesteuerung auf dem Gebiet der Nachlass- und Erbschaftssteuern (DBA-D) nicht anwendbar. Dem Staatsvertrag unterstehen nur Steuern, die von Todes wegen erhoben werden, somit auch nur Steuern für Schenkungen von Todes wegen. Eine Zuwendung an Dritte rund 14 Monate vor dem Tod des Erblassers, die dieser weder unter einem erbrechtlichen Titel gemacht noch die Bedachten als Erben oder Vermächtnisnehmer berufen hat, ist eine Schenkung unter Lebenden, auch wenn diese Zuwendung nach § 6 EStG erst nach dem Ableben des Schenkers durch die Erbschaftssteuer erfasst wird. Die Beschenkten, die in Deutschland Wohnsitz haben, können sich somit gegen die Veranlagung der Erbschaftssteuer am letzten Wohnsitz des Erblassers in der Schweiz nicht auf das DBA-D berufen, auch wenn die deutschen Behörden von ihnen bereits eine Schenkungssteuer auf den erhaltenen Betrag erhoben haben.
