art. 70).

Il appartient à l'État de prouver que toutes les conditions pour prononcer une
confiscation contre un tiers sont remplies (cf. SCHMID, Kommentar, Einziehung,
Organisiertes Verbrechen, Geldwäscherei, vol. I, Zurich 1998, n. 96, art. 59).
