The responsibility of\nthe operator shall include the custody of passengers and crew between the\naircraft and the terminal building and within the terminal building transit\narea, it being understood that the Contracting State may, if it so wishes, relieve\nthe operator from all, or part of this responsibility.\n[...]\n3.52.2 Recommended Practice.- After such acceptance, whether conditional or\nunconditional, the public authorities concerned should be responsible for the\ncustody and care of passengers and crew until they are legally admitted for\nentry or found to be inadmissible and transferred back to the custody of the\noperator for transport away from the territory of the State.\nII. Inspection and control of persons\nInspection of documents\n3.53 Operators shall take precautions at the point of embarkation to ensure\nthat passengers are in possession of the documents prescribed by the States of\ntransit and destination for control purposes as described in Chapter 3, Section\nB.\n3.54 Contracting States and operators shall cooperate, where practicable,\nin establishing the validity and authenticity of passports and visas that are\npresented by embarking passengers.\n3.54.1 Recommended Practice.- The appropriate public authorities of\nContracting States, either singly or jointly, should enter into cooperative\narrangements such as memoranda of understanding (MOUs) with the\noperators providing international services to and from those States, setting\nout guidelines for their mutual support and cooperation in countering the\nabuses associated with travel document fraud. Such arrangements should\nassign mutual responsibilities to the public authorities and to the operators,\nin the ascertainment of the validity and authenticity of the travel documents\nof embarking passengers, and in the necessary steps to prevent the loss or\ndestruction of documents by passengers en route to their destinations.\n[...]\n3.55 Contracting States shall not fine operators in the event that arriving and\nin-transit passengers are found to be improperly documented where the\noperators can demonstrate that they have taken adequate precautions to\nensure that the passengers had complied with the documentary requirements\nfor entry into the receiving State.\nInadmissible Persons\n[...]\n3.57 Recommended Practice.- In the event that the precautions referred to\nin 3.53 have been taken but the passenger is nevertheless not admitted due\nto document problems beyond the expertise of the operator or for reasons\nother than improper documents, the operator should not be held directly\nresponsible for any costs related to official detention of the passenger.[5]\n\n11\n3.58 The public authorities shall without delay inform the operator when\na person is found inadmissible and consult the operator regarding the\npossibilities for removal.\n[...]\n3.60 Each Contracting State shall ensure that a person found inadmissible is\ntransferred back into the custody of the operator, who shall be responsible for\nprompt removal to:\na) the point where the person commenced his journey; or\nb) to any place where the person is admissible.\n3.60.1 When the public authorities have reason to believe that a person who\nhas been declared inadmissible might offer resistance to his removal, they\nshall so inform the operator in sufficient time so that the operator can take\nprecautions to ensure the security of the flight.\nNote.- To this end, security should be provided by government officials, wherever\nappropriate under national regulations, or by the operator who should use his\nown security personnel or, at his expense, hire personnel whom he considers to\nbe competent.\n[...]\n3.62 When a person is found inadmissible and is returned to the operator\nfor transport away from the territory of the State, the operator shall not be\nprecluded from recovering from such person any transportation costs arising\nfrom his inadmissibility.\n[...]\n3.65 The obligation of an operator to transport any person away from the\nterritory of a Contracting State shall terminate from the moment such person\nhas been legally admitted for entry into that State.\n[...]»\n«I.
