4.2.1 Anspruch 1

Das Klagepatent beansprucht folgenden Gegenstand im unabhängigen
Anspruch 1:

1.1 A free drug particulate form of a compound having a formula

1.2 and pharmaceutically acceptable salts and solvates thereof
1.3 in which the compound is present as solid particles
1.4 not intimately embedded in a polymeric co-precipitate,
1.5 wherein at least 90% of the particles have a particle size of less than
about 40 microns.
