3. Art. 125 PatA; Art. 51 PatA; Prohibition of double patenting.
The loss of effect of the Swiss patent due to the existence of a European patent for the "same
invention" with the same effective date according to art. 125(1) PatA is subject to the condition
that the same technical teaching is protected in the claims of both patents (R. 37).
