In Bezug auf die japanische Patentanmeldung verweist die Klägerin, wo
folgendes festgehalten wird:

Article 33 (Right to obtain a patent)
(3) Where the right to obtain a patent is jointly owned, no joint owner may assign
his respective share without the consent of all the other joint owners.

Article 38 (Joint applications)
Where the right to obtain a patent is jointly owned, a patent application may only
be filed by all the joint owners.
