Zulassung eines Ausländers zum Anwaltspraktikum. Art. 31 BV: der Ausländer mit Jahresaufenthaltsbewilligung - der fremdenpolizeilichen Einschränkungen untersteht - kann sich nicht wie der Ausländer mit Niederlassungsbewilligung auf diese Verfassungsbestimmung berufen, um zum Anwaltspraktikum zugelassen zu werden (E. 2). Art. 4 BV: die ungleiche Behandlung bei der Erteilung der Niederlassungsbewilligung nach zehn bzw. fünf Jahren Aufenthalt ergibt sich aus Art. 7 Abs. 1 ANAG oder aus einem Staatsvertrag, d.h. aus Vorschriften, an die das Bundesgericht gemäss Art. 113 Abs. 3 BV gebunden ist (E. 3). Das Internationale Übereinkommen zur Beseitigung jeder Form von Rassendiskriminierung steht einer bevorzugten Behandlung von Ausländern aufgrund von internationalen Verpflichtungen nicht entgegen (E. 4)."

Accès au stage d'avocat d'un ressortissant étranger. Art. 31 Cst.: l'étranger titulaire d'une autorisation annuelle de séjour - qui est soumis aux restrictions de police des étrangers - ne peut pas se prévaloir de cette disposition constitutionnelle, au même titre que l'étranger au bénéfice d'un permis d'établissement, pour requérir son inscription au stage d'avocat (consid. 2). Art. 4 Cst.: l'inégalité de traitement dans l'octroi des permis d'établissement après dix ou cinq ans de séjour provient de l'art. 7 al. 1 LSEE ou d'un traité international, soit de textes qui lient le Tribunal fédéral en vertu de l'art. 113 al. 3 Cst. (consid. 3). La Convention internationale sur l'élimination de toutes formes de discrimination raciale ne s'oppose pas à un traitement préférentiel de ressortissants étrangers fondé sur des engagements internationaux (consid. 4)."

Accesso alla pratica legale di un cittadino straniero. Art. 31 Cost.: diversamente dal cittadino straniero al beneficio di un permesso di domicilio, lo straniero titolare di un permesso annuale di dimora - che è sottoposto alle restrizioni di polizia degli stranieri - non può invocare tale disposizione costituzionale per richiedere la sua iscrizione alla pratica legale (consid. 2). Art. 4 Cost.: disparità di trattamento nella concessione dei permessi di domicilio, dopo 10 rispettivamente 5 anni di soggiorno, creata dall'art. 7 cpv. 1 LDDS o da un trattato internazionale, ovvero da testi che vincolano il Tribunale federale in virtù dell'art. 113 cpv. 3 Cost. (consid. 3). La Convenzione internazionale sull'eliminazione di ogni forma di discriminazione razziale non vieta un trattamento preferenziale di cittadini stranieri fondato su impegni internazionali (consid. 4)."
