Art. 4 BV; Anspruch des Geschädigten auf unentgeltliche Rechtsverbeiständung im Beschwerdeverfahren gegen die Aufhebung der Strafuntersuchung. Voraussetzungen für einen direkt aus Art. 4 BV ableitbaren Anspruch (E. 2b). Die blosse Tatsache, dass der (angeblich) Geschädigte sich bei der Abfassung seiner Laienbeschwerde juristisch beraten liess, lässt seinen Anspruch nicht dahinfallen (E. 3a). In Berücksichtigung der persönlichen Verhältnisse des Geschädigten und der mangelnden Komplexität des Straffalles wird die Notwendigkeit der Rechtsverbeiständung hier jedoch verneint (E. 3b-e)."

Art. 4 Cst.; droit du lésé à l'assistance judiciaire gratuite dans la procédure de recours contre le classement d'une instruction pénale. Conditions auxquelles le lésé peut déduire directement de l'art. 4 Cst. un droit à l'assistance judiciaire gratuite (consid. 2b). Le seul fait que le lésé ait été conseillé juridiquement dans la rédaction de son recours ne rend pas caduc un tel droit (consid. 3a). L'octroi de l'assistance judiciaire n'est cependant pas nécessaire en l'espèce au regard des circonstances personnelles du lésé et de la simplicité du cas (consid. 3b-e)."

Art. 4 Cost.; diritto del leso al gratuito patrocinio nella procedura di ricorso contro un decreto di abbandono del procedimento penale. Condizioni alle quali il leso può dedurre un diritto al gratuito patrocinio direttamente dall'art. 4 Cost. (consid. 2b). Il solo fatto che colui che si pretende leso è stato consigliato giuridicamente nella redazione del suo ricorso non rende caduco il suo diritto (consid. 3a). In concreto, la concessione dell'assistenza giudiziaria non è tuttavia necessaria in considerazione della situazione personale del leso e della non complessità del procedimento penale (consid. 3b-e)."
