Art. 31 BV, Art. 10 EMRK; § 7 Abs. 2 und § 8 Abs. 1 des Zürcher Gesetzes vom 3. Juli 1938 über den Rechtsanwaltsberuf; Missachtung des Verbots aufdringlicher Werbung und der Pflicht, klare Rechtsverhältnisse zu schaffen. Verfassungsrechtliche Zulässigkeit von Werbebeschränkungen für Rechtsanwälte (E. 2a): Den Kantonen ist es erlaubt, aufdringliche und irreführende Werbung zu untersagen. Reklame mit übertriebenen Behauptungen und plakativem Herausstellen des eigenen Angebots kann als solche gelten (E. 2b u. c). Die Pflicht, klare Rechtsverhältnisse zu schaffen, ist im Zürcher Anwaltsrecht auch bei der Reklame zu beachten (E. 2d). Tragweite von Art. 10 EMRK (E. 2e)."

Art. 31 Cst., art. 10 CEDH; § 7 al. 2 et § 8 al. 1 de la loi zurichoise du 3 juillet 1938 sur la profession d'avocat; violation de l'interdiction de faire de la publicité tapageuse et de l'obligation d'établir des rapports de droit clairs. Constitutionnalité des limites imposées aux avocats au sujet de la publicité (consid. 2a): le canton peut interdire la publicité tapageuse et mensongère. La réclame contenant des affirmations exagérées et affichant les spécificités de l'offre de façon évidente peut être considérée comme telle (consid. 2b et c). En droit zurichois, l'obligation faite aux avocats d'établir des rapports de droit clairs doit aussi être prise en considération pour la publicité (consid. 2d). Costituzionalità dei limiti imposti agli avvocati in materia di pubblicità (consid. 2a): il cantone può proibire una pubblicità vistosa e mendace. Può essere considerata tale la pubblicità che contiene affermazioni esagerate e che ostenta le proprie specificità (consid. 2b e c). In diritto zurighese, l'obbligo imposto agli avvocati di stabilire chiari rapporti di diritto dev'essere preso in considerazione anche per quanto concerne la pubblicità (consid. 2d).
