Art. 64bis Abs. 2 BV und Art. 2 ÜbBest. BV; Art. 355 Abs. 2 StGB; Art. 4 des Konkordats über die Rechtshilfe und die interkantonale Zusammenarbeit in Strafsachen vom 5. November 1992 (SR 351.71). Gemäss Art. 4 in Verbindung mit Art. 3 des Konkordats kann eine mit einer Strafsache befasste Untersuchungsbehörde in Anwendung des Verfahrensrechts ihres Kantons eine Prozesshandlung direkt in einem anderen Kanton durchführen. Nach Art. 64bis Abs. 2 BV und den Zielen des Konkordats kann dieses die in Art. 355 Abs. 2 StGB festgelegte Regel \"locus regit actum\" brechen, ohne den Grundsatz der derogatorischen Kraft des Bundesrechts zu verletzen (E. 3)."

Art. 64bis al. 2 Cst. et art. 2 Disp. trans. Cst.; art. 355 al. 2 CP; art. 4 du concordat sur l'entraide judiciaire et la coopération intercantonale en matière pénale, du 5 novembre 1992 (RS 351.71). Selon l'art. 4 du concordat, lu en relation avec l'art. 3 du même texte, l'autorité judiciaire saisie d'une affaire pénale peut, en appliquant la procédure de son propre canton, accomplir un acte de procédure directement dans un autre canton. Au regard de l'art. 64bis al. 2 Cst. et des buts du concordat, celui-ci peut déroger à la maxime \"locus regit actum\" ancrée à l'art. 355 al. 2 CP sans violer pour autant le principe de la force dérogatoire du droit fédéral (consid. 3)."

Cost.; art. 355 cpv. 2 CP; art. 4 del concordato sull'assistenza giudiziaria e la cooperazione intercantonale in materia penale del 5 novembre 1992 (RS 351.71). Secondo l'art. 4, in relazione con l'art. 3 del concordato, l'autorità giudiziaria che conduce un procedimento penale può effettuare, applicando la procedura del proprio cantone, un atto di procedura direttamente in un altro cantone. Riguardo all'art. 64bis cpv. 2 Cost. e agli scopi del concordato, esso può derogare alla massima \"locus regit actum\" fissata all'art. 355 cpv. 2 CP senza violare il principio della forza derogatoria del diritto federale (consid. 3)."
