Art. 2 übBest. BV; Art. 57 Abs. 5 OG, Art. 688 ZGB, Art. 64 und 65 des Genfer Einführungsgesetzes zum Zivilgesetzbuch (EGZGB); Grundsatz, wonach die staatsrechtliche Beschwerde vorweg zu prüfen ist, Abstand der Anpflanzungen. In der staatsrechtlichen Beschwerde ist vorfrageweise zu prüfen, welches Recht - Bundesrecht oder kantonales Recht - auf die Sanktion der Bestimmungen anwendbar ist, welche die Kantone in Anwendung von Art. 688 ZGB zum Abstand der Anpflanzungen erlassen haben (E. 1). Art. 688 ZGB enthält einen echten, zuteilenden Vorbehalt im Sinne von Art. 5 ZGB, der die Kantone nicht nur dazu berechtigt, die Abstände festzulegen, welche die Eigentümer für die Anpflanzungen einzuhalten haben; vielmehr gibt er ihnen ausserdem das Recht, Sanktionen für die Verletzung der Bestimmungen vorzusehen, die sie auf diesem Gebiet erlassen (E. 2)."

Art. 2 Disp. trans. Cst.; art. 57 al. 5 OJ, art. 688 CC, art. 64 et 65 de la loi genevoise d'application du code civil et du code des obligations, du 7 mai 1981 (LACC); principe de l'examen préalable du recours de droit public, distance des plantations. C'est dans le recours de droit public qu'il convient de trancher préjudiciellement la question du droit - fédéral ou cantonal - applicable à la sanction des règles cantonales sur la distance des plantations prises en vertu de l'art. 688 CC (consid. 1). L'art. 688 CC contient une réserve propre au sens de l'art. 5 CC, qui est attributive; il autorise les cantons non seulement à déterminer les distances que les propriétaires sont tenus d'observer pour leurs plantations, mais aussi à arrêter les sanctions de la violation des règles qu'ils posent dans ce domaine (consid. 2)."

Va esaminata nell'ambito di un ricorso di diritto pubblico la questione pregiudiziale volta a sapere quale diritto - federale o cantonale - si applichi alle sanzioni delle norme che i Cantoni hanno adottato in virtù dell'art. 688 CC in merito alla distanza delle piantagioni (consid. 1). L'art. 688 CC contiene una riserva propria, attributiva di competenza, giusta l'art. 5 CC. Esso autorizza i Cantoni non solo a stabilire le distanze che i proprietari devono rispettare per le loro piantagioni, ma pure a determinare le sanzioni per la violazione delle regole che essi hanno fissato in tale materia (consid. 2)."
