Art. 3 und 37ter BV, Art. 2 ÜbBest. BV; Zuständigkeiten der Kantone für Einschränkungen des Startens und Landens mit Hängegleitern. Abstrakte Normenkontrolle; Legitimation (E. 1). Art. 37ter BV gibt dem Bund eine umfassende, aber keine ausschliessliche Kompetenz auf dem Gebiet der Luftfahrt. Die Kantone bleiben zuständig für Rechtsfragen, die der Bund nicht abschliessend geregelt hat (E. 2). Das Luftfahrtrecht des Bundes regelt das Starten und Landen mit Hängegleitern nicht abschliessend. Die Kantone bleiben zuständig für Einschränkungen im Interesse des Natur- und Heimatschutzes (E. 3 und 4). Das angefochtene Gesetz lässt Raum für eine verfassungskonforme, dem Verhältnismässigkeitsprinzip Rechnung tragende Anwendung (E. 5)."

Art. 3 et 37ter Cst., art. 2 Disp. trans. Cst.; compétences des cantons pour restreindre le décollage et l'atterrissage des planeurs de pente. Contrôle abstrait des normes; qualité pour recourir (consid. 1). L'art. 37ter Cst. confère à la Confédération une compétence générale, mais pas exclusive dans le domaine de la navigation aérienne. Les cantons demeurent compétents pour les questions juridiques que la Confédération n'a pas réglées de manière exhaustive (consid. 2). La législation fédérale sur la navigation aérienne ne règle pas exhaustivement le décollage et l'atterrissage des planeurs de pente. Les cantons restent compétents pour prévoir des restrictions dans l'intérêt de la protection de la nature et du paysage (consid. 3 et 4). La loi cantonale attaquée permet une application conforme à la Constitution et au principe de la proportionnalité (consid. 5)."
