Art. 4 BV: Legalitätsprinzip; Erhebung der Abgabe zur Förderung des Tourismus bei Vermögensverwaltungsgesellschaften im Kanton Genf. Das Ausführungs-Reglement des Staatsrats zum Genfer Tourismusgesetz sieht vor, dass die Abgabe zur Förderung des Tourismus von Vermögensverwaltungsgesellschaften erhoben werden kann; trotz seiner allgemeinen Formulierung stellt Art. 25 des Tourismusgesetzes eine genügende gesetzliche Grundlage für diese Regelung dar (E. 2). Die Beschwerdeführerin zieht als Vermögensverwaltungsgesellschaft direkten Nutzen aus dem Geschäftstourismus und profitiert insofern von den günstigen Auswirkungen der Tourismusförderung in Genf. Es ist daher weder willkürlich, noch wird das Gleichbehandlungsgebot verletzt, wenn sie gestützt auf das erwähnte Reglement die streitige Abgabe entrichten muss (E. 3)."

Art. 4 Cst.: principe de la légalité; assujettissement des entreprises de gestion de fortunes à la taxe genevoise d'encouragement au tourisme. Malgré sa formulation générale, l'art. 25 de la loi genevoise sur le tourisme constitue une base légale suffisante permettant au Conseil d'Etat de prévoir dans son règlement d'application de ladite loi l'assujettissement à la taxe d'encouragement au tourisme des entreprises de gestion de fortunes (consid. 2). La recourante bénéficie, en tant qu'entreprise de gestions de fortunes, des retombées directes du tourisme d'affaires et retire ainsi des avantages particuliers de la promotion touristique de Genève, de sorte qu'elle peut, sans arbitraire et sans violation du principe de l'égalité de traitement, être assujettie à la taxe litigieuse en application du règlement précité (consid. 3)."

Il regolamento di applicazione alla legge ginevrina sul turismo sancisce l'assoggettamento alla tassa sulla promozione del turismo delle aziende di amministrazione di patrimoni; malgrado la sua formulazione generale, l'art. 25 della legge ginevrina sul turismo costituisce una base legale sufficiente per una simile normativa (consid. 2). Quale azienda di amministrazione di patrimoni, la ricorrente beneficia delle ricadute dirette del turismo d'affari e in tal misura profitta dei vantaggi particolari della promozione turistica di Ginevra. Ne discende che il suo assoggettamento alla tassa litigiosa, derivante dal menzionato regolamento, non viola né il divieto dell'arbitrio né quello della disparità di trattamento (consid. 3)."
