Art. 84 Abs. 1 und Art. 88 OG; Anfechtbarkeit fremdenpolizeilicher Richtlinien. Eine Verwaltungsverordnung ist mit staatsrechtlicher Beschwerde anfechtbar, wenn sie Aussenwirkungen entfaltet und keine förmliche Verfügung ergeht, die der Betroffene wirksam und zumutbar anfechten könnte (E. 2). Weder aus Art. 8 BVO noch aus Art. 4 BV (Willkür, Vertrauensschutz) oder Art. 31 BV ergibt sich ein rechtlich geschütztes Interesse, um eine verwaltungsinterne Regelung anzufechten, die Aufenthaltsbewilligungen für Tänzer und Tänzerinnen in Nachtclubs oder ähnlichen Lokalen, deren Darbietungen der erotischen Unterhaltung dienen, nur noch für Angehörige von EU- oder EFTA-Staaten vorsieht (E. 3)."

Une ordonnance administrative peut être attaquée par la voie du recours de droit public, si elle déploie des effets externes et ne donne pas lieu à décision formelle contre laquelle l'intéressé pourrait raisonnablement recourir de manière efficace (consid. 2). Ni de l'art. 8 OLE, ni des art. 4 Cst. (arbitraire et protection de la bonne foi) ou 31 Cst. ne découle un intérêt juridiquement protégé pour attaquer une réglementation administrative interne qui limite aux seuls ressortissants des pays de l'Union européenne et de l'AELE l'octroi des autorisations de séjour destinées aux danseurs et danseuses, dont les productions dans des boîtes de nuit ou locaux analogues ont une connotation érotique (consid. 3)."

Art. 84 cpv. 1 e 88 OG; impugnabilità di direttive in materia di polizia degli stranieri. Un'ordinanza amministrativa può essere contestata con ricorso di diritto pubblico, quando ha effeti esterni e non dà luogo a una decisione formale, contro la quale il diretto interessato potrebbe ragionevolmente ricorrere in modo efficace (consid. 2). Né l'art. 8 OLS né gli art. 4 Cost. (arbitrio e protezione della buona fede) e 31 Cost. concedono un interesse giuridicamente protetto ad impugnare una regolamentazione amministrativa interna, la quale prevede il rilascio ai soli cittadini dei paesi dell'Unione europea o dell'AELS di permessi di dimora per ballerini e ballerine che si esibiscono in spettacoli a connotazione erotica in locali notturni o analoghi (consid. 3)."
