Art. 2 ÜbBest. BV; Art. 836 ZGB; kantonales Steuerpfandrecht für Liquidationsgewinnsteuer. Die Frage der Vereinbarkeit eines kantonalen Steuerpfandrechts mit dem Bundeszivilrecht ist keine Zivilrechtsstreitigkeit; daher ist nicht die Berufung, sondern die staatsrechtliche Beschwerde zulässig (Klarstellung der schwankenden Rechtsprechung) (E. 1). Ein Steuerpfandrecht zur Sicherung der Liquidationsgewinnsteuer ist insoweit zulässig, als der Liquidationsgewinn auf eine Wertsteigerung des Grundstücks zurückgeht, nicht aber, soweit er auf andere Faktoren zurückzuführen ist (Präzisierung der Praxis) (E. 2)."

La question de la compatibilité d'un droit de gage fiscal cantonal avec le droit civil fédéral n'est pas une contestation de droit civil; c'est pourquoi, il y a lieu d'agir par la voie du recours de droit public et non par celle du recours en réforme (clarification d'une jurisprudence fluctuante) (consid. 1). Une hypothèque légale de droit fiscal en garantie de l'impôt sur le bénéfice de liquidation n'est admissible que si le bénéfice de liquidation provient d'une plus-value de l'immeuble, mais pas s'il est imputable à d'autres facteurs (précision de la jurisprudence)(consid. 2)."

La questione della compatibilità di un diritto di pegno del fisco, previsto dal diritto cantonale, con il diritto civile federale non è una causa civile; di conseguenza, è ammissibile il ricorso di diritto pubblico, non il ricorso per riforma (chiarimento della giurisprudenza scostante) (consid. 1). Un'ipoteca legale fiscale a garanzia dell'imposta sull'utile risultante da una liquidazione è ammissibile solo se tale utile proviene da un aumento di valore dell'immobile, non invece se è imputabile ad altri fattori (precisazione della giurisprudenza) (consid. 2)."
