Art. 4 BV; Art. 1 Ziff. XVII des Steuerbeschlusses für 1996: jährliche Steuer auf Gebäuden als Feuerschutzabgabe. Die strittige Abgabe ist eine (spezielle) Kostenanlastungssteuer, die folglich den strengen verfassungsmässigen Anforderungen an Steuern genügen muss (E. 3 und 4). Sie stützt sich auf eine genügende gesetzliche Grundlage, soweit diese durch den kommunalen Gesetzgeber aufgrund einer im kantonalen Gesetz vorgesehenen und nach der Verfassung des Kantons Waadt zulässigen Delegation von Rechtsetzungsbefugnissen erlassen worden ist (E. 5). Die gesetzliche Regelung dieser Steuer verletzt den Grundsatz der Rechtsgleichheit, soweit einzig Grundeigentümer steuerpflichtig sind, bestimmte Eigentümer ohne objektiven Grund von der Steuerpflicht befreit werden und die mit dieser Steuer zu finanzierenden Aufgaben und Auslagen nicht genau bestimmt sind (E. 6)."

Art. 4 Cst.; art. 1er ch. XVII de l'arrêté d'imposition pour l'année 1996: impôt annuel sur les bâtiments au titre de frais de défense contre l'incendie. La contribution litigieuse est un impôt (spécial) d'affectation lié à certains coûts particuliers qui doit par conséquent satisfaire aux mêmes exigences constitutionnelles strictes qu'un impôt (consid. 3 et 4). Elle repose sur une base légale suffisante, dans la mesure où celle-ci a été adoptée par le législateur communal sur la base d'une délégation prévue par une loi cantonale et autorisée par la Cst. vaudoise (consid. 5). La réglementation de cet impôt est contraire au principe de l'égalité de traitement en tant qu'il frappe uniquement les propriétaires immobiliers, que certains propriétaires sont exonérés sans motif objectif et que les activités et dépenses qu'il doit financer ne sont pas déterminées précisément (consid. 6)."

Art. 4 Cost.; art. 1o n. XVII del decreto sull'imposizione per l'anno 1996: imposta annuale sugli edifici a titolo di contributo per la difesa contro gli incendi. Il tributo litigioso è un'imposta (speciale) a destinazione vincolata, legata a taluni costi particolari: come tale, esso deve soddisfare le medesime rigorose esigenze costituzionali che devono adempire le imposte (consid. 3 e 4). Esso riposa su di una base legale sufficiente, nella misura in cui è stato adottato dal legislatore comunale sulla base di una delega contenuta in una legge cantonale e autorizzata dalla Costituzione vodese (consid. 5). La regolamentazione di tale tributo è contraria al principio della parità di trattamento in quanto esso colpisce unicamente i proprietari immobiliari, siccome taluni proprietari ne sono esentati senza ragioni obiettive e, infine, poiché le attività e le spese che esso deve finanziare non sono determinate precisamente (consid. 6)."
