Art. 4 BV; Art. 84 Abs. 2, 88 und 100 lit. b Ziff. 3 OG, Art. 4 und Art. 17 Abs. 2 ANAG; Anspruch auf unentgeltliche Rechtspflege bei Verweigerung der Aufenthaltsbewilligung an eine Ausländerin und ihre Kinder, die im Familiennachzug in die Schweiz gelangt sind und nunmehr getrennt von ihrem Ehemann bzw. Vater leben. Ausschluss der Verwaltungsgerichtsbeschwerde in der Hauptsache und damit auch für die Frage der unentgeltlichen Prozessführung; Zulässigkeit der staatsrechtlichen Beschwerde im Hinblick auf den Anspruch auf unentgeltliche Prozessführung als Parteirecht (E. 1). Voraussetzungen des aus Art. 4 BV abgeleiteten Anspruchs auf unentgeltliche Rechtspflege und Verbeiständung (E. 2). Beurteilung der Aussichtslosigkeit einer Beschwerde im Zusammenhang mit einem Bewilligungsverfahren, in der die zuständige Behörde über freies Ermessen verfügte (E. 3)."

Art. 4 Cst.; Art. 84 al. 2, 88 et 100 let. b ch. 3 OJ, art. 4 et 17 al. 2 LSEE; droit à l'assistance judiciaire dans la procédure de refus d'autorisation de séjour d'une étrangère et de ses enfants, qui ont réussi à entrer en Suisse en vue d'un regroupement familial et qui vivent désormais séparés de leur époux et père. Le recours de droit administratif n'est pas ouvert sur le fond; il est dès lors également irrecevable contre la décision relative à l'assistance judiciaire; recevabilité du recours de droit public à l'égard du refus de l'assistance judiciaire, considérée comme un droit d'une partie (consid. 1). Conditions du droit, découlant de l'art. 4 Cst., à l'assistance judiciaire et à un avocat d'office (consid. 2). En l'espèce, le recours déposé contre le refus d'une autorisation de séjour, sur lequel l'autorité compétente pouvait statuer librement, était dénué de chances de succès (consid. 3)."

Art. 4 Cost., art. 84 cpv. 2, art. 88 e 100 lett. b n. 3 OG, art. 4 e 17 cpv. 2 LDDS; diritto all'assistenza giudiziaria nella procedura di rifiuto del permesso di dimora a una straniera e ai suoi figli, entrati in Svizzera nell'ambito del ricongiungimento familiare e che oramai vivono separati dal marito, rispettivamente, dal padre. Siccome il ricorso di diritto amministrativo è escluso sul merito, lo è anche per quanto concerne la questione dell'assistenza giudiziaria. Ammissibilità del ricorso di diritto pubblico contro il rifiuto dell'assistenza giudiziaria, considerata quale diritto di parte (consid. 1). Presupposti per potere beneficiare del diritto, sgorgante dall'art. 4 Cost., all'assistenza giudiziaria e alla nomina di un avvocato d'ufficio (consid. 2). Nel caso concreto, il ricorso esperito contro il rifiuto del permesso di dimora, in merito al quale l'autorità competente si pronuncia con piena cognizione, era sprovvisto di possibilità di esito favorevole (consid. 3)."
