Art. 4 und 58 BV, Art. 2 ÜbBest. BV, Art. 5 Ziff. 4 EMRK; Zürcher Gesetzesänderungen betreffend fürsorgerische Freiheitsentziehung; abstrakte Normenkontrolle. § 5a der Zürcher Zivilprozessordnung (ZPO), wonach der Richter am Ort der Anstalt zur Behandlung eines Gesuchs um gerichtliche Beurteilung der fürsorgerischen Freiheitsentziehung zuständig ist, verletzt Art. 2 ÜbBest. BV, Art. 58 BV und Art. 4 BV nicht (E. 2b/aa-cc). Es verstösst nicht gegen Bundesrecht, wenn nach dem kantonalen Recht die Berufung auch gegen einen den Freiheitsentzug aufhebenden Entscheid des Einzelrichters zulässig ist (E. 2c/aa). Die Vorschrift von § 203e Abs. 2 Ziff. 4 ZPO, die den Kreis der Verfahrensbeteiligten gegenüber dem Bundesrecht einschränkt, verletzt Art. 2 ÜbBest. BV (E. 2c/bb). Die zürcherische Regelung des Berufungsverfahrens ist mit Art. 397f Abs. 1 ZGB und Art. 5 Ziff. 4 EMRK vereinbar (E. 2d)."

Cst.; art. 5 par. 4 CEDH; modifications législatives, dans le canton de Zurich, relatives à la privation de liberté à des fins d'assistance; contrôle abstrait des normes. Le § 5a du code de procédure civile du canton de Zurich (CPC), selon lequel le juge du for dans lequel se trouve l'établissement est compétent pour traiter une demande tendant au contrôle judiciaire de la privation de liberté à des fins d'assistance, ne viole ni l'art. 2 Disp. trans. Cst., ni les art. 58 et 4 Cst. (consid. 2b/aa-cc). N'est pas contraire au droit fédéral la réglementation du droit cantonal qui admet également la recevabilité d'un appel contre le prononcé du juge unique admettant la demande de libération (consid. 2c/aa). Le § 203e al. 2 ch. 4 CPC, qui définit le cercle des parties de façon plus restrictive que le droit fédéral, viole l'art. 2 Disp. trans. Cst. (consid. 2c/bb). La procédure d'appel du droit cantonal zurichois est conforme à l'art. 397f al. 1 CC et à l'art. 5 par. 4 CEDH (consid. 2d)."

Art. 4 e 58 Cost., art. 2 Disp. trans. Cost., art. 5 n. 4 CEDU; modifiche legislative, nel cantone Zurigo, relative alla privazione della libertà a scopo d'assistenza; controllo astratto delle norme. Il § 5a del codice di procedura civile zurighese (CPC), secondo cui il giudice del foro in cui si trova lo stabilimento è competente per trattare una domanda tendente al controllo giudiziario della privazione della libertà a scopo d'assistenza, non viola l'art. 2 Disp. trans. Cost., né gli art. 58 e 4 Cost. (consid. 2b/aa-cc). Non è contrario al diritto federale la regolamentazione del diritto cantonale che ammette la ricevibilità di un appello anche contro la pronunzia del giudice unico che accoglie la domanda di rilascio (consid. 2c/aa). Il § 203e cpv. 2 n. 4 CPC zurighese, che definisce la cerchia delle parti in maniera più restrittiva che il diritto federale, viola l'art. 2 Disp. trans Cost. (consid. 2c/bb). La procedura di appello del diritto zurighese è conforme all'art. 397f cpv. 1 CC e all'art. 5 n. 4 CEDU (consid. 2d)."
