Art. 84 ff., Art. 88 OG; Art. 22ter BV. Enteignung eines Streifens Bauland für die Erstellung einer Strasse, Bestimmung der Enteignungsentschädigung. Veräusserung der streitbetroffenen Parzelle während des enteignungsrechtlichen Schätzungsverfahrens; Bedeutung für die Legitimation des Verkäufers und des Käufers zur staatsrechtlichen Beschwerde (Art. 88 OG; E. 1). Umfang der Überprüfung eines angefochtenen Entscheides; Kognition des Bundesgerichtes bei der Überprüfung einer Enteignungsentschädigung (E. 2). Methoden zur Bestimmung der Enteignungsentschädigung; Vorrang der Vergleichsmethode (statistische Methode; E. 3a). Besteht eine bestimmte Wohnzone nur aus einer kleinen Anzahl Grundstücke, können für die Festsetzung der Enteignungsentschädigung Vergleichspreise herangezogen werden, welche für Parzellen in anderen Wohnzonen bezahlt werden; Ausgleich der unterschiedlichen (auch planerischen) Beschaffenheiten der in Betracht kommenden Liegenschaften durch Auf- und Abschläge (E. 3b). Blosse Offerten, Verhandlungspreise oder Verkaufspreise unter Miteigentümern des enteigneten Grundstücks stellen keine zu berücksichtigenden Vergleichspreise dar, wenn sie wesentlich vom Ansprecher der Enteignungsentschädigung mitbestimmt worden sind (E. 3c). Bei einer Teilenteignung (Enteignung von Vorgartenland) kann vom Verkehrswert ein Abzug gemacht werden, wenn auf dem Restgrundstück die gleiche bauliche Nutzung möglich ist, wie sie vor der Enteignung für die ganze Parzelle galt (E. 4)."

Aliénation de la parcelle litigieuse pendant une procédure d'estimation selon le droit de l'expropriation; conséquences quant à la qualité du vendeur et de l'acheteur pour former un recours de droit public (art. 88 OJ; consid. 1). Etendue de l'examen d'une décision attaquée; cognition du Tribunal fédéral lorsqu'il revoit une indemnité d'expropriation (consid. 2). Méthodes pour fixer une indemnité d'expropriation; priorité de la méthode comparative (méthode statistique; consid. 3a). Lorsqu'une zone d'habitation n'est formée que d'un petit nombre de biens-fonds, on peut prendre comme éléments de comparaison, pour estimer un terrain de cette zone, des prix payés pour des parcelles situées dans d'autres zones d'habitation; compensation, par une majoration ou une diminution, pour tenir compte des qualités différentes (également du point de vue de l'aménagement du territoire) des immeubles concernés (consid. 3b). De simples offres, des prix évoqués lors de pourparlers ou des prix convenus entre précédents copropriétaires du bien-fonds exproprié - lorsque le prix a été déterminé essentiellement par celui qui réclame l'indemnité d'expropriation -, ne sont pas des prix de comparaison à prendre en considération (consid. 3c). En cas d'expropriation partielle (expropriation d'un jardin devant une maison), la valeur vénale peut être diminuée dans une certaine mesure quand l'utilisation du solde du terrain pour la construction n'est pas affectée par l'expropriation, les possibilités de bâtir demeurant identiques à celles offertes sur l'ensemble de la parcelle (consid. 4)."

Alienazione della particella litigiosa durante la procedura espropriativa di stima; conseguenze per la legittimazione del venditore e del compratore ad interporre ricorso di diritto pubblico (art. 88 OG; consid. 1). Estensione dell'esame di una decisione impugnata; cognizione del Tribunale federale in materia di indennità d'espropriazione (consid. 2). Metodi per fissare l'indennità d'espropriazione; prevalenza del metodo comparativo (metodo statistico; consid. 3a). Se una determinata zona abitativa si compone unicamente di pochi fondi, per la determinazione dell'indennità d'espropriazione possono essere presi quali elementi di paragone i prezzi pagati per delle particelle in altre zone abitative; compensazione, mediante maggiorazione o diminuzione, per le differenti particolarità (anche dal punto di vista pianificatorio) degli immobili presi in considerazione (consid. 3b). Semplici offerte, prezzi discussi durante le trattative o stabiliti dai comproprietari del fondo espropriato non possono servire da paragone, se sono stati determinati essenzialmente da colui che pretende un'indennità d'espropriazione (consid. 3c). Nell'ambito di un'espropriazione parziale (espropriazione del terreno complementare), il valore venale può essere diminuito, se la parte rimanente del fondo permette uno sfruttamento edificatorio uguale a quello esistente su tutta la particella prima dell'espropriazione (consid. 4)."
