Art. 85 lit. a OG. Finanzreferendum. Gemeindeordnung und Finanzreglement der Stadt St. Gallen; Schutzbautenverordnung vom 27. November 1978 (BMV). Kredit für die Erstellung einer Bereitstellungsanlage für den Zivilschutz als neue Ausgabe (E. 2b). Bei der Ermittlung der massgeblichen Kosten nach dem Nettoprinzip darf die Gemeinde den aus Ersatzbeiträgen für nicht erstellte Schutzräume (Art. 7 BMV) finanzierten Teil nicht von den Gesamtkosten der Vorlage in Abzug bringen; eine solche Fondsentnahme gilt weder als Beitrag eines Dritten noch als dem Referendum nicht unterstehende zweckgebundene Ausgabe (E. 3)."

Art. 85 let. a OJ. Référendum financier. Loi communale et règlement des finances de la ville de St-Gall; ordonnance sur les constructions de protection civile du 27 novembre 1978 (OCPCi). Crédit en vue de la construction d'un poste d'attente de protection civile en tant que dépense nouvelle (consid. 2b). Pour calculer les coûts déterminants selon le principe de la dépense nette, la commune ne peut déduire du montant total du crédit la partie financée par des contributions de remplacements pour des abris non construits (art. 7 OCPCi); un tel prélèvement de fonds ne peut être considéré ni comme une contribution d'un tiers ni comme une dépense liée non exposée au référendum (consid. 3)."

Credito per la costruzione di un impianto d'apprestamento della protezione civile come spesa nuova (consid. 2b). Per calcolare i costi determinanti secondo il principio della spesa netta, il comune non può dedurre dall'insieme delle spese del credito la parte finanziata mediante contributi sostitutivi per rifugi non costruiti (art. 7 OEPCi); un siffatto prelievo di fondi non può essere considerato né come una contribuzione di un terzo, né come una spesa vincolata non sottoposta a referendum (consid. 3)."
