Ungleichbehandlung eines ausserkantonalen Anwalts: Weigerung, dem ausserkantonalen, in Neuenburg niedergelassenen Anwalt die Akten des Strafverfahrens zuzustellen, während diese Verfahrenserleichterung den Waadtländer Anwälten zugestanden wird. Beschwerdelegitimation des Anwalts, des minderjährigen Angeschuldigten sowie seines gesetzlichen Vertreters (E. 1b). Ist die Zustellung der Strafakten an den Verteidiger eine wesentliche Modalität der Gewährung des Rechts auf Akteneinsicht, die grundsätzlich durch Art. 4 BV garantiert wird (E. 2)? Aus dem angefochtenen Entscheid ergibt sich eine unzulässige Ungleichbehandlung bei der Ausübung der Verteidigerrechte; er verletzt somit auch Art. 6 Ziff. 3 lit. b EMRK in Verbindung mit Art. 14 EMRK, Art. 14 Ziff. 1 UNO-Pakt II, Art. 14 Ziff. 3 lit. b UNO-Pakt II in Verbindung mit Art. 2 Ziff. 1 UNO-Pakt II (E. 3a-c) und, unter den hier gegebenen Umständen, Art. 4 BV (E. 3d). Tragweite des Konkordats über die Rechtshilfe und die interkantonale Zusammenarbeit in Strafsachen; Anspruch auf verfahrensrechtliche Gleichbehandlung gemäss Art. 60 BV (E. 3e). Mit dem angefochtenen Entscheid werden überdies Ansprüche verletzt, die einem Anwalt nach Art. 31 BV und Art. 5 ÜbBest. BV zustehen (E. 4)."

Discrimination de l'avocat établi dans un autre canton: refus d'envoyer le dossier de la cause pénale à l'étude du défenseur établi à Neuchâtel, alors que cette facilité est accordée aux avocats vaudois. Qualité pour recourir de l'avocat, du prévenu mineur et de son représentant légal (consid. 1b). L'envoi du dossier à l'avocat mandaté est-il une modalité essentielle de l'accès au dossier, garantie en principe par l'art. 4 Cst. (consid. 2)? La décision attaquée comporte une discrimination inadmissible dans l'exercice des droits de la défense; elle viole dès lors, en particulier, l'art. 6 par. 3 let. b CEDH en liaison avec l'art. 14 CEDH, l'art. 14 par. 1 Pacte ONU II, l'art. 14 par. 3 let. b Pacte ONU II en liaison avec l'art. 2 par. 1 Pacte ONU II (consid. 3a-c) et, dans les circonstances de l'espèce, l'art. 4 Cst. (consid. 3d). Portée du concordat sur l'entraide judiciaire et la coopération intercantonale en matière pénale; droit de non-discrimination procédurale garanti par l'art. 60 Cst. (consid. 3e). Discriminazione dell'avvocato residente fuori dal cantone: rifiuto d'inviare l'incarto del procedimento penale allo studio del difensore residente a Neuchâtel quando questa facilitazione è accordata agli avvocati vodesi. Legittimazione a ricorrere dell'avvocato, dell'imputato minorenne e del suo rappresentante legale (consid. 1b). L'invio dell'incarto penale all'avvocato costituisce una modalità essenziale per la consultazione degli atti garantita, di massima, dall'art. 4 Cost. (consid. 2)? La decisione impugnata implica una discriminazione inammissibile nell'esercizio dei diritti della difesa; essa viola, pertanto, in particolare, l'art. 6 n. 3 lett. b CEDU in relazione con l'art. 14 CEDU, l'art. 14 n. 1 del Patto ONU II, l'art. 14 n. 3 lett. b Patto ONU II in relazione con l'art. 2 n. 1 Patto ONU II (consid. 3a-c) e, nelle circostanze concrete, l'art. 4 Cost. (consid. 3d). Portata del concordato sull'assistenza giudiziaria e la cooperazione intercantonale in materia penale; diritto di non discriminazione procedurale garantito dall'art. 60 Cost.
