Anspruch auf Steuerbefreiung im Umfang des Rechts auf Existenzsicherung? Besteuerung nach der wirtschaftlichen Leistungsfähigkeit; Rechtsgleichheit im Steuerrecht. Art. 4 BV; Art. 11 Abs. 1 des Paktes vom 16. Dezember 1966 über wirtschaftliche, soziale und kulturelle Rechte; Art. 7 Abs. 4 lit. k des Bundesgesetzes vom 14. Dezember 1990 über die Harmonisierung der direkten Steuern der Kantone und Gemeinden (StHG). Art. 11 Abs. 1 des Paktes über wirtschaftliche, soziale und kulturelle Rechte begründet keine subjektiven Rechte des Einzelnen (E. 2a). Anspruch auf Steuerbefreiung im Umfang des bundesverfassungsrechtlichen Anspruchs auf Existenzsicherung? (E. 2b und 3). Vorliegend ist der Anspruch jedenfalls nicht verletzt (E. 4). Die Rechtsgleichheit gibt keinen Anspruch auf Steuerbefreiung von Einkünften bis zur Höhe der (gemäss Art. 7 Abs. 4 lit. k StHG steuerbefreiten) Leistungen aufgrund der Bundesgesetzgebung über Ergänzungsleistungen zur AHV/IV (E. 5)."

Droit à une exonération d'impôt correspondant au droit à des conditions minimales d'existence? Imposition selon la capacité contributive; égalité de traitement en droit fiscal. Art. 4 Cst.; art. 11 al. 1 du Pacte international relatif aux droits économiques, sociaux et culturels du 16 décembre 1966; art. 7 al. 4 lettre k de la loi fédérale sur l'harmonisation des impôts directs des cantons et des communes du 14 décembre 1990 (LHID). L'art. 11 al. 1 du Pacte international ne confère aucun droit subjectif au particulier (consid. 2a). Droit à une exonération d'impôt par rapport au droit constitutionnel fédéral non écrit à des conditions minimales d'existence (consid. 2b et 3). En l'espèce, le droit à des conditions minimales d'existence n'est de toute façon pas violé (consid. 4). Le principe de l'égalité de traitement ne donne aucun droit à une exonération fiscale de revenus jusqu'à concurrence des prestations (exonérées de l'impôt selon l'art. 7 al. 4 lettre k LHID) obtenues en vertu de la législation fédérale sur les prestations complémentaires à l'assurance-vieillesse, survivants et invalidité (consid. 5)."

Diritto a un'esenzione fiscale corrispondente al diritto a condizioni minime di esistenza? Imposizione in base alla capacità contributiva; parità di trattamento nel diritto fiscale. Art. 4 Cost.; art. 11 cpv. 1 del Patto internazionale relativo ai diritti economici, sociali e culturali; art. 7 cpv. 4 lett. k della legge federale sull'armonizzazione delle imposte dirette dei Cantoni e dei Comuni, del 14 dicembre 1990 (LAID). L'art. 11 cpv. 1 del Patto internazionale relativo ai diritti economici, sociali e culturali non conferisce alcun diritto soggettivo al singolo (consid. 2a). Diritto ad un'esenzione fiscale corrispondente al diritto costituzionale federale a condizioni minime di esistenza? (consid. 2b e 3). In concreto il diritto a condizioni minime di esistenza non è stato ad ogni modo leso (consid. 4). Il principio della parità di trattamento non conferisce alcun diritto ad un'esenzione fiscale di redditi fino a concorrenza dei proventi (esenti dall'imposta in conformità all'art. 7 cpv. 4 lett. k LAID) ricevuti in virtù della legislazione federale sulle prestazioni complementari all'assicurazione per la vecchiaia, i superstiti e l'invalidità (consid. 5)."
