Art. 84 ff. OG; Art. 13 EMRK; Zulässigkeit der staatsrechtlichen Beschwerde gegen Aufsichtsentscheide. Entscheide, mit welchen auf eine Aufsichtsbeschwerde nicht eingetreten, diese abgewiesen oder ihr keine Folge gegeben wird, sind nicht mit staatsrechtlicher Beschwerde anfechtbar (E. 1a; Bestätigung der Rechtsprechung). Soweit auf kantonaler Ebene die Möglichkeit besteht, sich gegen Grundrechtsverletzungen durch Realakte auf andere Weise als allein mittels Aufsichtsbeschwerde zur Wehr zu setzen, erfordert die Garantie eines wirksamen Rechtsschutzes gemäss Art. 13 EMRK nicht, die staatsrechtliche Beschwerde auch gegen abschlägige Aufsichtsentscheide zuzulassen (E. 1b)."

Art. 84 ss OJ; art. 13 CEDH; recevabilité du recours de droit public contre des décisions de l'autorité de surveillance. Les décisions par lesquelles l'autorité de surveillance refuse d'entrer en matière sur une plainte, la rejette ou n'y donne pas suite, ne peuvent être attaquées par la voie du recours de droit public (consid. 1a; confirmation de la jurisprudence). Dans la mesure où il existe au niveau cantonal la possibilité de faire valoir ses griefs tirés de la violation des droits fondamentaux résultant d'un acte matériel (\"Realakt\") par d'autres voies que le seul moyen de la plainte à l'autorité de surveillance, la garantie de la protection juridique effective ancrée à l'art. 13 CEDH n'exige pas que la voie du recours de droit public soit aussi ouverte contre les décisions négatives de l'autorité de surveillance (consid. 1b)."

Art. 84 segg. OG; art. 13 CEDU; ammissibilità del ricorso di diritto pubblico contro decisioni dell'autorità di vigilanza. Le decisioni con cui l'autorità di vigilanza rifiuta di esaminare il merito di una denuncia, la respinge o non vi dà seguito, non possono essere impugnate con ricorso di diritto pubblico (consid. 1a; conferma della giurisprudenza). Nella misura in cui è possibile far valere a livello cantonale le proprie censure relative a violazioni di diritti fondamentali risultanti da atti materiali (\"Realakt\"), usando altre vie che il solo rimedio della denuncia all'autorità di vigilanza, la garanzia della protezione giuridica effettiva sancita dall'art. 13 CEDU non esige che la via del ricorso di diritto pubblico sia anche data contro le decisioni negative emanate dall'autorità di vigilanza (consid. 1b)."
