Internationale Schiedsgerichtsbarkeit; Anzahl der Mitglieder des Schiedsgerichts (Art. 179 Abs. 2 IPRG; Art. 10 und 11 Schiedsgerichtskonkordat). Zulässigkeit einer staatsrechtlichen Beschwerde wegen Verletzung von Art. 4 BV, die sich gegen einen Entscheid richtet, mit dem die Ernennung eines Schiedsrichters in Anwendung von Art. 179 Abs. 2 IPRG abgelehnt worden ist (E. 1). Fehlt eine Parteiabmachung über die Mehrheitsbestimmung im Sinne von Art. 11 Abs. 4 Schiedsgerichtskonkordat, so ist nur dann davon auszugehen, die Schiedsparteien hätten sich auf eine gerade Anzahl von Schiedsrichtern geeinigt, wenn eine entsprechende, nicht anders auslegbare Vereinbarung vorliegt (E. 2)."

Recevabilité d'un recours de droit public pour violation de l'art. 4 Cst. dirigé contre une décision de refus de nomination d'un arbitre prise en application de l'art. 179 al. 2 LDIP (consid. 1). A défaut d'accord des parties sur un système permettant de dégager une majorité au sens de l'art. 11 al. 4 CIA, il convient de n'admettre que les parties sont convenues d'un nombre pair d'arbitres qu'en présence d'une convention ne souffrant pas d'autre interprétation (consid. 2)."
