Art. 4 BV; Art. 46 Abs. 2 BV; Kinderalimente. Kinderalimente stehen im interkantonalen Verhältnis dem Wohnsitzkanton des Empfängers zur ausschliesslichen Besteuerung zu; selbst wenn dieser Kanton sie nicht besteuert, muss sie der Wohnsitzkanton des Verpflichteten zum Abzug von dessen steuerbarem Einkommen zulassen (E. 2). Im innerkantonalen Verhältnis steht es den Kantonen bis zur vollen Wirksamkeit des Steuerharmonisierungsgesetzes frei, die Kinderalimente beim Verpflichteten nicht zum Abzug zuzulassen (E. 3)."

Art. 4 Cst.; art. 46 al. 2 Cst.; contributions pour l'entretien des enfants. Dans les rapports intercantonaux, les contributions versées pour l'entretien des enfants doivent être imposées exclusivement dans le canton de domicile du parent qui les reçoit; même si ce canton ne les impose pas, le canton de domicile de celui qui est astreint à les payer doit admettre qu'elles soient déduites de son revenu imposable (consid. 2). Dans les rapports internes, les cantons peuvent toutefois, jusqu'à ce que la loi fédérale sur l'harmonisation fiscale devienne pleinement effective, refuser d'admettre la déduction des contributions pour l'entretien des enfants par celui qui est astreint à les payer (consid. 3)."

Nei rapporti intercantonali, i contributi per il mantenimento dei figli devono essere tassati esclusivamente nel cantone di domicilio del genitore che li riceve; anche se questo cantone non li impone, il cantone di domicilio di colui che è obbligato a versarli deve ammettere che vengano dedotti dal reddito imponibile (consid. 2). Nei rapporti interni, i cantoni possono rifiutare, sino alla completa entrata in vigore della legge federale sull'armonizzazione fiscale, di ammettere la deduzione dei contributi per il mantenimento dei figli da parte di colui che è obbligato a versarli (consid. 3)."
