Art. 22ter BV; Art. 19 und 20 RPG; Art. 4 ff. WEG; Sicherstellung einer hinreichenden Zufahrt; Pflicht des Grundeigentümers, einem Nachbarn dienende Erschliessungsanlagen auf seinem Land zu dulden (\"öffentlichrechtliches Notwegrecht\", § 104 PBG SO). Hinreichende Zufahrt gemäss Art. 19 Abs. 1 RPG; Land entlang einer öffentlichen Strasse, welches ausserhalb einer Hausbaulinie liegt und im Zonenplan gleich wie das Strassenareal behandelt wird (keine Nutzungszone), kann für die Errichtung von Hauszufahrten beansprucht werden (E. 3). Flächen für Erschliessungsanlagen sind primär mit planerischen Mitteln sicherzustellen (E. 4). Können die für eine hinreichende Zufahrt notwendigen Wegrechte nicht auf vertraglicher Basis erworben werden, ist nach Art. 20 RPG und Art. 4 ff. WEG (SR 843) vorzugehen; eine \"Wegnot\" (im Sinne von § 104 PBG SO) liegt erst vor, wenn die Voraussetzungen für die Einleitung von Parzellarordnungsmassnahmen nicht gegeben sind (E. 5a und b). Mit der Anordnung, ein öffentlichrechtliches Notwegrecht zu dulden, sind alle weiteren damit verbundenen Rechte und Pflichten (z.B. der Wegunterhalt) zu regeln (E. 5c)."

Voie d'accès suffisante selon l'art. 19 al. 1 LAT; un terrain situé le long d'une voie publique, hors du périmètre à bâtir, et assimilé à une aire routière selon le plan de zones, peut être mis à contribution pour la création d'une voie d'accès à une maison d'habitation (consid. 3). Les surfaces nécessaires à la création de voies d'accès doivent être délimitées en premier lieu dans le cadre de la planification (consid. 4). Lorsque les droits de passage indispensables à cette fin ne peuvent être constitués sur une base contractuelle, il y a lieu de procéder selon les art. 20 LAT et 4 ss LCAP; un droit de passage au sens de l'art. 104 LATC/SO n'entre en ligne de compte que lorsque les conditions pour la mise en oeuvre d'un remaniement parcellaire ne sont pas réalisées (consid. 5a et b). L'autorité qui ordonne qu'un droit de passage fondé sur le droit public soit toléré, doit régler tous les droits et obligations qui en résultent, tel l'entretien de la voie d'accès, par exemple (consid. 5c)."

LCAP; garanzia di un accesso sufficiente; obbligo del proprietario di tollerare sul proprio fondo impianti d'urbanizzazione necessari al suo vicino (\"accesso necessario fondato sul diritto pubblico\" secondo l'art. 104 LALPT/SO). Accesso sufficiente secondo l'art. 19 cpv. 1 LPT; un terreno situato lungo la pubblica via, fuori del perimetro edificabile e assimilato a un'area stradale secondo il piano delle zone, può essere preteso per la creazione di accessi a case di abitazione (consid. 3). Le superfici necessarie alla realizzazione di accessi devono essere delimitate in primo luogo nell'ambito della pianificazione (consid. 4). Quando i diritti di passo necessari a tal fine non possono essere costituiti su di una base contrattuale, occorre procedere secondo l'art. 20 LPT e 4 segg. LCAP; un diritto di passo ai sensi dell'art. 104 LALPT/SO entra in linea di conto soltanto quando non sono adempiuti i presupposti per ordinare una ricomposizione particellare (consid. 5a e b). L'autorità che ordina che sia tollerato un diritto di passo fondato sul diritto pubblico deve regolare tutti i diritti e gli obblighi che ne risultano, quali, per esempio, la manutenzione della via di accesso (consid. 5c)."
