Art. 4 BV, Art. 68 Abs. 1 SchKG und Art. 54 Abs. 2 GebVSchKG; Anspruch auf unentgeltliche Rechtspflege im Rechtsöffnungsverfahren. Der aus Art. 4 BV abgeleitete Anspruch auf unentgeltliche Rechtspflege ist grundsätzlich auch für das Rechtsöffnungsverfahren gewährleistet (Änderung der Rechtsprechung). Unter den allgemeinen Voraussetzungen ist der Gläubiger bzw. der Schuldner von der Pflicht befreit, einen Kostenvorschuss gemäss Art. 68 Abs. 1 SchKG und Art. 54 Abs. 2 GebVSchKG zu leisten."

Le droit à l'assistance judiciaire découlant de l'art. 4 Cst. peut également être invoqué dans la procédure de mainlevée d'opposition (modification de la jurisprudence).
