Art. 4 BV, Art. 133bis Abs. 1 lit. a BdBSt; Anspruch auf einen begründeten Entscheid, Anforderungen an die Bemessung der Zusatzstrafe. Ist gemäss Art. 133bis Abs. 1 lit. a BdBSt eine Zusatzstrafe auszufällen, so hat der Richter die Grundsätze von Art. 68 Ziff. 1 StGB anzuwenden und anzugeben, welche Strafe er jeweils für eine der beiden Straftaten ausspricht, damit das Bundesgericht gegebenenfalls weiss, welche Strafe er wegen des Vergehens gegen die direkte Bundessteuer verhängt hat, welches allein Gegenstand einer eidgenössischen Nichtigkeitsbeschwerde sein kann (E. 2)."

Art. 4 Cst., art. 133bis al. 1 let. a AIFD; droit à une décision motivée, exigences quant à la fixation de la peine complémentaire. Lorsqu'il doit prononcer une peine complémentaire conformément à l'art. 133bis al. 1 let. a AIFD, le juge, tout en appliquant les principes de l'art. 68 ch. 1 CP, doit indiquer quelle est la peine qui sanctionne chacune des deux infractions, afin que le Tribunal fédéral, le cas échéant, puisse savoir quelle peine a été prononcée pour le délit commis en matière d'impôt fédéral direct, qui seul peut faire l'objet d'un pourvoi en nullité (consid. 2)."

Art. 4 Cost., art. 133bis cpv. 1 lett. a DIFD; diritto ad una decisione motivata, esigenze concernenti la determinazione della pena complementare. Ove debba pronunciare una pena complementare ai sensi dell'art. 133bis cpv. 1 lett. a DIFD, il giudice è tenuto ad indicare, in applicazione dei principi di cui all'art. 68 n. 1 CP, la pena inflitta per ciascuno dei due delitti, di guisa che il Tribunale federale sappia, all'occorrenza, quale pena sia stata pronunciata per il delitto commesso in materia di imposta federale diretta, che è il solo suscettibile di un ricorso per cassazione (consid. 2)."
