Art. 15 Abs. 3 und Art. 85 lit. a OG. Politische Rechte; Konkretisierung einer Initiative in Form einer allgemeinen Anregung. Der Begriff des \"Entscheids über die Zulässigkeit einer Initiative\" gemäss Art. 15 Abs. 3 OG ist umfassend auszulegen, so dass er nicht nur Entscheide über die Frage betrifft, ob eine Angelegenheit der Volksabstimmung unterbreitet werden muss, sondern auch, in welcher Form dies zu geschehen hat (E. 1). Legitimation eines Bürgers und einer politischen Partei, im Rahmen einer gestützt auf Art. 85 lit. a OG erhobenen staatsrechtlichen Beschwerde geltend zu machen, der dem Stimmvolk unterbreitete Gesetzesentwurf gäbe die Initiative kaum mehr wieder (E. 2a). Ausschöpfung des kantonalen Instanzenzuges und Zulässigkeit der Beschwerde (E. 2b-d). Überprüfungsbefugnis des Bundesgerichts im Rahmen von Art. 85 lit. a OG (E. 3). Grundsätze des Tessiner Rechts über die Behandlung von Initiativen in Form der allgemeinen Anregung (E. 4a) und Zusammenfassung der bundesgerichtlichen Rechtsprechung (E. 4b). Im vorliegenden Fall überschritt das kantonale Parlament beim Erlass des angefochtenen Gesetzesentwurfs den ihm zustehenden Beurteilungsspielraum bei der Konkretisierung der Initiative (E. 5 und 6). Vollumfängliche Aufhebung des angefochtenen Entscheids, damit das kantonale Parlament sich erneut frei über die ganze Sache äussern kann (E. 6b)."

Art. 15 al. 3 et 85 let. a OJ. Droits politiques; concrétisation d'une initiative conçue en termes généraux. La notion de \"décision ayant trait à la recevabilité d'une initiative\" selon l'art. 15 al. 3 OJ doit être interprétée de manière large, en ce sens qu'elle ne concerne pas seulement la question de savoir si un objet doit être soumis au vote populaire, mais aussi celle de savoir sous quelle forme il doit l'être (consid. 1). Qualité d'un citoyen et d'un parti politique pour faire valoir, à l'appui d'un recours de droit public fondé sur l'art. 85 let. a OJ, que le projet de loi soumis au vote populaire dénaturerait la portée de l'initiative (consid. 2a). Epuisement des instances cantonales et recevabilité du recours (consid. 2b-d). Pouvoir d'examen du Tribunal fédéral dans le cadre de l'art. 85 let. a OJ (consid. 3). Principes du droit tessinois relatifs au traitement d'une initiative conçue en termes généraux (consid. 4a) et résumé de la jurisprudence du Tribunal fédéral (consid. 4b). Dans le cas concret, le Parlement cantonal a excédé la latitude de jugement qui lui était reconnue dans la concrétisation de l'initiative en adoptant le projet de loi litigieux (consid. 5 et 6). Annulation totale de la décision attaquée afin de permettre au Parlement cantonal de se prononcer à nouveau librement sur la question (consid. 6b)."

Art. 15 cpv. 3 e 85 lett. a OG. Diritti politici; concretizzazione di un'iniziativa generica. La nozione di \"decisione sull'ammissibilità di un'iniziativa\" dell'art. 15 cpv. 3 OG deve essere interpretata in modo ampio, ossia nel senso ch'essa non comprende solo la questione di sapere se una proposta debba essere sottoposta al voto popolare, ma anche quella di sapere in che forma essa debba essergli sottoposta (consid. 1). Legittimazione di un cittadino e di un partito politico ad invocare a sostegno di un ricorso di diritto pubblico fondato sull'art. 85 lett. a OG la censura secondo cui il progetto di legge sottoposto al popolo snatura l'iniziativa (consid. 2a). Esaurimento del corso delle istanze cantonali e ricevibilità del ricorso (consid. 2b-d). Potere d'esame del Tribunale federale nel quadro dell'art. 85 lett. a OG (consid. 3). Principi del diritto ticinese relativi alla trattazione di un'iniziativa generica (consid. 4a) e riassunto della giurisprudenza del Tribunale federale (consid. 4b). Nel caso concreto, il Parlamento cantonale, adottando il contestato progetto di legge, ha ecceduto la latitudine di giudizio che gli competeva per concretare l'iniziativa generica (consid. 5 e 6). Annullamento totale della decisione impugnata, alfine di consentire al Parlamento cantonale di pronunciarsi nuovamente e liberamente sulla questione (consid. 6b)."
