Art. 22ter und 31 BV; nebenberufliche Erwerbstätigkeit eines Beamten. Wird gegen einen kantonalen Entscheid ein Wiedererwägungsgesuch und zugleich staatsrechtliche Beschwerde erhoben und wird das Wiedererwägungsgesuch abgelehnt, so muss der Wiedererwägungsentscheid nicht erneut mit staatsrechtlicher Beschwerde angefochten werden (E. 1a). Der Beamte kann sich für die Ausübung einer nebenberuflichen privatwirtschaftlichen Tätigkeit auf die Handels- und Gewerbefreiheit berufen (Präzisierung der Rechtsprechung). Eine Einschränkung derselben ist zulässig, um das Ansehen der Beamten und das öffentliche Vertrauen in ihre Unparteilichkeit sicherzustellen. Es ist nicht verfassungswidrig, einem Bezirksanwalt für Wirtschaftsdelikte die Übernahme eines Verwaltungsratsmandats zu untersagen (E. 2). Aufgrund der Eigentumsgarantie darf der Beamte sein Vermögen verwalten. Die Ausübung eines Verwaltungsratsmandats geht über die Vermögensverwaltung hinaus (E. 3)."

Art. 22ter et 31 Cst.; activité lucrative accessoire d'un fonctionnaire. Lorsqu'une demande de reconsidération et un recours de droit public sont déposés simultanément à l'encontre d'une décision cantonale et que la demande de reconsidération est rejetée, il n'est pas nécessaire d'attaquer également la décision de reconsidération par un recours de droit public (consid. 1a). Un fonctionnaire peut invoquer la liberté du commerce et de l'industrie lors de l'exercice d'une activité lucrative accessoire dans l'économie privée (précision de la jurisprudence). Cette liberté peut être limitée afin de préserver la réputation du fonctionnaire et la confiance du public dans son impartialité. Il n'est pas contraire à la Constitution fédérale de refuser à un procureur de district compétent en matière de délits économiques le droit d'assumer un mandat dans un conseil d'administration (consid. 2). En vertu de la garantie de la propriété, un fonctionnaire peut administrer son patrimoine. L'exercice d'un mandat dans un conseil d'administration va au-delà de l'administration du patrimoine (consid. 3)."

Art. 22ter e 31 Cost.; attività lucrativa accessoria esercitata da un funzionario. Se una domanda di riconsiderazione e un ricorso di diritto pubblico sono inoltrati contemporaneamente contro una decisione cantonale e la domanda di riconsiderazione viene respinta, non è necessario impugnare nuovamente la domanda di riconsiderazione con ricorso di diritto pubblico (consid. 1a). Un funzionario può invocare la libertà di commercio e d'industria per quanto concerne l'esercizio di un'attività lucrativa accessoria nel settore dell'economia privata (precisazione della giurisprudenza). Una limitazione di questa libertà è ammissibile, al fine di preservare la reputazione del funzionario e la fiducia del pubblico nella sua imparzialità. Non è contrario alla Costituzione negare a un procuratore distrettuale competente in materia di delitti economici il diritto di assumere un mandato in un consiglio di amministrazione (consid. 2). In virtù della garanzia della proprietà, un funzionario può amministrare il proprio patrimonio. L'esercizio di un mandato in un consiglio di amministrazione va oltre l'amministrazione del patrimonio (consid. 3)."
