Art. 6 Ziff. 3 lit. d EMRK, Art. 4 BV; Recht auf Einvernahme von Be- und Entlastungszeugen. Die Einvernahme eines V-Mannes darf in der Regel nicht verweigert werden, es sei denn, sichere Anhaltspunkte würden ausschliessen, dass er eine wichtigere Rolle gespielt hat, als aus den Akten ersichtlich ist (E. 1). Art. 6 Ziff. 1 EMRK, Recht auf öffentliche Verhandlung. Falls die Geheimhaltung eines V-Mannes nicht mit anderen Mitteln möglich ist, kann dessen Einvernahme unter Ausschluss der Öffentlichkeit erfolgen (E. 2)."

Lorsqu'un agent infiltré est intervenu dans une affaire, son audition ne peut en principe pas être refusée en l'absence d'éléments permettant d'exclure avec certitude qu'il ait joué un rôle plus important qu'il n'apparaît à la lecture du dossier (consid. 1). Art. 6 par. 1 CEDH, droit à la publicité des débats. Le huis clos peut être ordonné pour l'audition d'un agent infiltré si son anonymat ne peut pas être sauvegardé par un autre moyen (consid. 2)."
