Art. 5 Ziff. 4 EMRK; Anspruch auf gerichtliche Überprüfung der Rechtmässigkeit des Freiheitsentzugs. Erfolgt der Freiheitsentzug am Ende eines gerichtlichen Verfahrens, d.h. als Ergebnis einer strafrechtlichen Verurteilung im Sinne von Art. 5 Ziff. 1 lit. a EMRK, so ist die von Art. 5 Ziff. 4 EMRK verlangte Kontrolle in der Regel für die gesamte Dauer des Freiheitsentzugs im Strafurteil des Gerichts mit enthalten. Keine Abweichung von dieser Regel in einem Fall, in welchem die Verwaltungsbehörde eine Verfügung betreffend die Übertragung des Vollzugs eines schweizerischen Strafurteils an die Behörden eines ausländischen Staates widerrufen und die Fortsetzung des Strafvollzugs in der Schweiz angeordnet hatte."

Art. 5 par. 4 CEDH; contrôle judiciaire de la proportionnalité d'une privation de liberté. Lorsque la privation de liberté fait suite à une procédure judiciaire ayant abouti à une condamnation pénale au sens de l'art. 5 par. 1 let. a CEDH, le contrôle exigé par l'art. 5 par. 4 CEDH est en général incorporé dans la décision judiciaire, pour toute la durée de la détention. Il n'y a pas lieu de faire exception à cette règle lorsque l'autorité administrative révoque une décision concernant la délégation à l'étranger de l'exécution d'un jugement pénal suisse, et ordonne la suite de l'exécution en Suisse."

Art. 5 n. 4 CEDU; controllo giudiziario della proporzionalità di una privazione della libertà. Quando la privazione della libertà è decisa in seguito ad una procedura giudiziaria che ha dato luogo ad una condanna penale ai sensi dell'art. 5 n. 1 lett. a CEDU, il controllo richiesto dall'art. 5 n. 4 CEDU è, in linea di principio, incluso nella decisione giudiziaria, per tutta la durata della detenzione. Non fa eccezione a questa regola il caso in cui l'autorità amministrativa revoca una decisione concernente la delega dell'esecuzione di un giudizio penale svizzero ad uno Stato estero e ordina il proseguimento dell'esecuzione in Svizzera."
