Art. 4 und 31 BV; Gleichbehandlung von Zirkusunternehmen bei der Zurverfügungstellung öffentlichen Grundes. Eintreten auf die staatsrechtliche Beschwerde trotz fehlenden aktuellen Rechtsschutzinteresses (E. 1). \"Bedingter Anspruch\" auf Bewilligung des gesteigerten Gemeingebrauchs. Einschränkung durch formell-gesetzliche Grundlage, die keine Kriterien für die Bewilligungserteilung enthält (E. 2). Zulässigkeit einer zurückhaltenden Bewilligungserteilung für Zirkusdarbietungen mit Rücksicht auf örtliche Verhältnisse (E. 3). Ableitung des Grundsatzes der Gleichbehandlung der Gewerbegenossen; Art. 31 BV bietet einen über Art. 4 BV hinausreichenden Schutz bei der Regelung des gesteigerten Gemeingebrauchs (Bestätigung der Rechtsprechung) (E. 4). Direktes Konkurrenzverhältnis; verneint für das Verhältnis zwischen einem herkömmlichen Zirkus und einem Jugendzirkus (E. 5a). Zulässigkeit der Bevorzugung ortsansässiger Unternehmen hinsichtlich der Benützung öffentlicher Sachen, jedenfalls im Lichte von Art. 4 BV (E. 5c). Tragweite des Anspruchs auf Gleichbehandlung der Gewerbegenossen: keine absolute Gleichbehandlung, aber Pflicht zur Schaffung fairer Wettbewerbsverhältnisse (E. 6b). Berücksichtigung objektiver Unterschiede zwischen den Bewerbern; Zulässigkeit kulturpolitischer Anliegen; Unzulässigkeit gewerbe- oder wirtschaftspolitischer Überlegungen (E. 6c). Verhältnismässigkeit und Pflicht zur sachgemässen Interessenabwägung. Diese Pflicht ist verletzt, wenn ohne überzeugende Begründung direkte Konkurrenten im Verhältnis von 1 zu 5-6 ungleich behandelt werden (E. 6d/e)."

Art. 4 e 31 Cost.; parità di trattamento tra circhi in materia di messa a disposizione di suolo pubblico. Ammissibilità del ricorso di diritto pubblico anche in assenza di un interesse giuridico attuale (consid. 1). \"Diritto condizionale\" a ottenere un'autorizzazione per un uso accresciuto del suolo pubblico. Limitazione fondata su di una base legale formale, la quale non prevede alcun criterio per il rilascio dell'autorizzazione (consid. 2). Viste le circostanze locali, è lecito concedere in modo restrittivo autorizzazioni per spettacoli di un circo (consid. 3). Applicazione del principio della parità di trattamento tra concorrenti; l'art. 31 Cost. garantisce una migliore protezione di quella sancita dall'art. 4 Cost. per quanto concerne la regolamentazione dell'uso accresciuto del suolo pubblico (conferma della giurisprudenza) (consid. 4). Rapporto di concorrenza diretta; negato per quanto concerne la relazione esistente tra un circo tradizionale e un circo di giovani (consid. 5a). È lecito trattare in modo privilegiato imprese locali in materia di utilizzazione di beni pubblici, perlomeno per quanto concerne l'art. 4 Cost. (consid. 5c). Portata del diritto alla parità di trattamento tra concorrenti: non vi è parità di trattamento assoluta, ma l'obbligo di creare rapporti di concorrenza corretti (consid. 6b). Considerazione delle differenze obiettive tra i concorrenti; è lecito tener conto di esigenze di carattere politico-culturale, non invece di considerazioni di carattere politico-commerciale oppure politico-economico (consid. 6c). Proporzionalità e obbligo di procedere a una ponderazione adeguata degli interessi. Quest'obbligo è disatteso quando, senza motivi convincenti, concorrenti diretti sono trattati diversamente in un rapporto da 1 a 5-6 (consid. 6d/e)."
