Legalitätsprinzip. Abgabe eines Honoraranteils aus privatärztlicher Tätigkeit von Belegärzten. Nach der Praxis zu Art. 4 BV besteht im Verfahren der Rechtsetzung kein Anspruch auf rechtliches Gehör; selbst wenn ein solcher Anspruch anzuerkennen wäre, könnten dafür nicht unbesehen die Grundsätze übernommen werden, die beim Erlass von Verfügungen gelten (E. 2). Die Honorarabgabe nach § 8 des zugerischen Spitalgesetzes ist eine kostenunabhängige Abgabe, die nicht dem Kostendeckungsprinzip unterliegt. Die formell-gesetzliche Grundlage, welche die Festsetzung der Höhe innerhalb des Maximums von 40% an den Regierungsrat delegiert, ist genügend bestimmt (E. 3)."

Principe de la légalité. Remise à l'Etat d'une partie des honoraires provenant de l'activité médicale privée exercée par des médecins indépendants dans des hôpitaux subventionnés. Selon la jurisprudence relative à l'art. 4 Cst., il n'existe aucun droit d'être entendu dans la procédure législative; même si un tel droit devait être reconnu, les principes développés à propos des décisions ne pourraient pas être repris tels quels (consid. 2). La remise d'honoraires prévue au § 8 de la loi zougoise sur les hôpitaux constitue une taxe indépendante des frais, qui n'est pas soumise au principe de la couverture des coûts. La base légale formelle, qui délègue au Conseil d'Etat la compétence d'en fixer le montant à 40% au maximum des honoraires perçus, est suffisamment précise (consid. 3)."

Principio della legalità. Versamento allo Stato di una parte degli onorari provenienti dall'attività medica privata esercitata da medici indipendenti in ospedali sovvenzionati. Secondo la giurisprudenza concernente l'art. 4 Cost., non esiste alcun diritto di essere sentito nella procedura legislativa; anche qualora un simile diritto dovesse venire riconosciuto, non sarebbe possibile riprendere tali e quali i principi sviluppati in merito alle decisioni (consid. 2). Il versamento degli onorari previsto al § 8 della legge zughese sugli ospedali costituisce un tributo indipendente dalle spese, che non soggiace al principio della copertura dei costi. È sufficientemente precisa la base legale formale che delega al Consiglio di Stato la competenza di fissare l'importo a non oltre il 40% degli onorari percepiti (consid. 3)."
