Art. 88 OG: Beschwerdelegitimation einer privatrechtlichen Vereinigung bei einer spitalplanerischen Massnahme. Beschwerdebefugnis öffentlichrechtlicher Körperschaften bzw. privatrechtlich organisierter Vereinigungen (E. 2). Als privatrechtliche Vereinigung, die unter staatlicher Aufsicht eine öffentliche Aufgabe wahrnimmt, kann sich die Beschwerdeführerin nicht mit staatsrechtlicher Beschwerde gegen eine spitalplanerische Massnahme zur Wehr setzen, durch die ihr eine öffentliche Aufgabe bzw. die sich daraus ergebende Subventionsberechtigung entzogen wird (E. 3); sie ist auch nicht befugt, eine Verletzung des rechtlichen Gehörs geltend zu machen (E. 4)."

Art. 88 OJ: qualité d'une corporation de droit privé pour recourir contre une mesure de planification hospitalière. Conditions auxquelles une corporation de droit public ou de droit privé peut recourir (consid. 2). En tant que corporation de droit privé qui participe aux tâches de l'Etat en étant soumise à sa surveillance, la recourante n'a pas qualité pour contester une mesure de planification hospitalière qui lui retire la compétence d'exercer une activité publique, du moins en tant que cet exercice donne droit à des subventions (consid. 3); elle n'a pas davantage qualité pour se plaindre d'une violation du droit d'être entendu (consid. 4)."

Art. 88 OG: legittimazione ricorsuale di una corporazione di diritto privato contro una misura di pianificazione ospedaliera. Condizioni alle quali una corporazione di diritto pubblico o di diritto privato può ricorrere (consid. 2). Nella sua veste di corporazione di diritto privato che svolge compiti pubblici essendo sottoposta alla sorveglianza dello Stato, la ricorrente non può impugnare una misura di pianificazione ospedaliera, che le ritira la competenza di esercitare un'attività pubblica, rispettivamente, la priva dei sussidi che ne derivano (consid. 3); essa non può neppure addurre una violazione del suo diritto di essere sentita (consid. 4)."
