Art. 89 OG; Beginn des Fristenlaufs bei der Anfechtung eines genehmigungspflichtigen Erlasses. Die Publikation einer Verordnung vor der Einholung der konstitutiven Genehmigung des Bundes löst den Lauf der Beschwerdefrist gemäss Art. 89 Abs. 1 OG nicht aus (E. 1a und b). Bestimmung der Frist, wenn nach der Genehmigung der Verordnung durch den Bund keine zweite Publikation erfolgt (E. 1c). Art. 85 lit. a OG; Ausgestaltung des Verfahrens der brieflichen Stimmabgabe. Das Bundesrecht schreibt den Kantonen die nähere Ausgestaltung des Verfahrens der brieflichen Abstimmung nicht vor. Diese muss aber den in Art. 8 Abs. 1 des Bundesgesetzes über die politischen Rechte erwähnten Grundsätzen Rechnung tragen und eine zuverlässige und unverfälschte Willenskundgabe der Bürger ermöglichen (E. 3a). Die im Kanton Basel-Stadt vorgesehene anonyme briefliche Stimmabgabe genügt diesen Anforderungen nicht (E. 3b-g)."

Art. 89 OJ; commencement du délai en cas de contestation d'un arrêté soumis à approbation. Le délai prévu par l'art. 89 al. 1 OJ ne commence pas à courir au moment où une ordonnance est publiée si l'approbation constitutive de la Confédération n'a pas encore été obtenue (consid. 1a et b). Point de départ du délai lorsque l'approbation fédérale n'est pas suivie d'une nouvelle publication (consid. 1c). Art. 85 let. a OJ; procédure du vote par correspondance. Le droit fédéral n'impose pas aux cantons une réglementation détaillée de la procédure du vote par correspondance; ceux-ci doivent toutefois tenir compte des principes consacrés par l'art. 8 al. 1 de la loi fédérale sur les droits politiques et garantir une expression fidèle et sûre de la volonté des citoyens (consid. 3a). Le vote par correspondance anonyme prévu dans le canton de Bâle-Ville ne satisfait pas à cette exigence (consid. 3b-g)."

Art. 89 OG; inizio del termine in caso di contestazione nel caso di decreto soggetto ad approvazione. Il termine previsto dall'art. 89 cpv. 1 OG non comincia a decorrere al momento in cui un'ordinanza è pubblicata allorché l'approvazione costitutiva della Confederazione non è ancora stata data (consid. 1a e b). Inizio del termine allorché l'approvazione federale non è seguita da una nuova pubblicazione (consid. 1c). Art. 85 lett. a OG; procedura di voto per corrispondenza. Il diritto federale non impone ai cantoni una regolamentazione dettagliata della procedura di voto per corrispondenza; questi devono tuttavia tener conto dei principi sanciti dall'art. 8 cpv. 1 della legge federale sui diritti politici e garantire una fedele e sicura espressione della volontà popolare (consid. 3a). Il voto per corrispondenza anonimo, previsto nel cantone di Basilea-Città, non soddisfa questa esigenza (consid. 3b-g)."
