Art. 4 BV; überspitzter Formalismus und Grundsatz von Treu und Glauben. Die Behörde, welche einen Quartierplan nicht in vorgeschriebener Weise bekanntgemacht und damit den Anspruch auf rechtliches Gehör der davon betroffenen Grundeigentümer missachtet hat, und gegebenenfalls auch die Rechtsmittelbehörden müssen dafür sorgen, dass der Mangel im weiteren Verfahren behoben werden kann, beispielsweise durch Wiederherstellung der Einsprachefrist (E. 2b/bb). Die Weigerung, das von den betroffenen Grundeigentümern gestellte Gesuch um Aussetzung des Plangenehmigungsverfahrens als Gesuch um Wiederherstellung der Einsprachefrist entgegenzunehmen, verstösst unter den vorliegenden Umständen gegen das Verbot des überspitzten Formalismus und verletzt das Prinzip von Treu und Glauben (E. 2b/cc)."

L'autorité qui ne respecte pas le droit d'être entendu des propriétaires fonciers touchés par un plan de quartier en omettant de procéder à sa publication dans les formes exigées et, à son défaut, les autorités de recours doivent faire en sorte que cette omission puisse être réparée dans la suite de la procédure, par exemple en leur restituant le délai d'opposition (consid. 2b/bb). Le refus de considérer la demande de suspension de la procédure d'homologation du plan présentée par les propriétaires fonciers concernés comme une demande de restitution du délai d'opposition constitue, dans les circonstances de l'espèce, un formalisme excessif et viole le principe de la bonne foi (consid. 2b/cc)."

Il diniego di considerare la domanda di sospensione della procedura di omologazione del piano presentata dai proprietari fondiari interessati come una domanda di restituzione del termine di opposizione costituisce, nelle circostanze concrete, un formalismo eccessivo e viola il principio della buona fede (consid. 2b/cc)."
