Die streitige Gerichtsstandsklausel Ziff. 18.6 des Quality Agreements vom
29. / 30 Januar bzw. vom 10. Februar 2014 (KB 4) lautet wie folgt:
«This Agreement and the deliveries of the Product are subject to the laws of Switzerland (to the
exclusion of the provisions of the United Nations Conventions on contracts for the International Sale of
Goods). Each party submits to the exclusive jurisdiction of the courts of Berne, Switzerland.»
